بَابُ مِيرَاثِ الْمُكَاتَبِ إِذَا عَتَقَInheritance of the Mukatab if he is freed
Hadith 1299B2
قَالَ : وَهَذَا أَيْضًا فِي كُلِّ مَنْ أُعْتِقَ، فَإِنَّمَا مِيرَاثُهُ لِأَقْرَبِ النَّاسِ مِمَّنْ أَعْتَقَهُ مِنْ وَلَدٍ أَوْ عَصَبَةٍ مِنَ الرِّجَالِ يَوْمَ يَمُوتُ الْمُعْتَقُ، بَعْدَ أَنْ يَعْتِقَ وَيَصِيرَ مَوْرُوثًا بِالْوَلَاءِ . ¤
Imam Malik, may Allah have mercy on him, said that in this way, if a person is set free, then his inheritance will go to the closest relative of the one who set him free, whether it is a son or any other male agnate, on the day that the slave died.
