Hadith 1298B2

قَالَ مَالِك، فِي مُكَاتَبٍ مَرِضَ مَرَضًا شَدِيدًا، فَأَرَادَ أَنْ يَدْفَعَ نُجُومَهُ كُلَّهَا إِلَى سَيِّدِهِ لِأَنْ يَرِثَهُ وَرَثَةٌ لَهُ أَحْرَارٌ، وَلَيْسَ مَعَهُ فِي كِتَابَتِهِ وَلَدٌ لَهُ، قَالَ مَالِك : ذَلِكَ جَائِزٌ لَهُ، لِأَنَّهُ تَتِمُّ بِذَلِكَ حُرْمَتُهُ وَتَجُوزُ شَهَادَتُهُ وَيَجُوزُ اعْتِرَافُهُ بِمَا عَلَيْهِ مِنْ دُيُونِ النَّاسِ وَتَجُوزُ وَصِيَّتُهُ، وَلَيْسَ لِسَيِّدِهِ أَنْ يَأْبَى ذَلِكَ عَلَيْهِ، بِأَنْ يَقُولَ : فَرَّ مِنِّي بِمَالِهِ
Imam Malik, may Allah have mercy on him, said that if a mukatab becomes seriously ill, and he wishes to pay all the installments to his master and become free so that his heirs, who are already free, may inherit from him and are not included in his contract of manumission, then this is permissible for the mukatab. This is because his sanctity is thus fulfilled, his testimony is valid, the acknowledgment of debts he makes to people is valid, his will is valid, and his master cannot object on the grounds that he wants to save his wealth.
