وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
حُمَيْدِ بْنِ قَيْسٍ الْمَكِّيِّ ، عَنْ رَجُلٍ يُقَالُ لَهُ
ذَفِيفٌ ، أَنَّهُ قَالَ : سُئِلَ
ابْنُ عَبَّاسٍ عَنِ الْعَزْلِ، فَدَعَا جَارِيَةً لَهُ، فَقَالَ : " أَخْبِرِيهِمْ "، فَكَأَنَّهَا اسْتَحْيَتْ، فَقَالَ : " هُوَ ذَلِكَ
أَمَّا أَنَا فَأَفْعَلُهُ " يَعْنِي أَنَّهُ يَعْزِلُ . قَالَ مَالِكٌ : لَا يَعْزِلُ الرَّجُلُ عَنِ الْمَرْأَةِ الْحُرَّةِ إِلَّا بِإِذْنِهَا، وَلَا بَأْسَ أَنْ يَعْزِلَ عَنْ أَمَتِهِ بِغَيْرِ إِذْنِهَا، وَمَنْ كَانَتْ تَحْتَهُ أَمَةُ قَوْمٍ فَلَا يَعْزِلُ إِلَّا بِإِذْنِهِمْ
It is narrated from Dhufayf that Sayyiduna Ibn Abbas (may Allah be pleased with them both) was asked: Is coitus interruptus (withdrawal) permissible or not? He called his slave-girl and said: Tell them, but she felt shy before Sayyiduna Abdullah ibn Abbas (may Allah be pleased with them both). He said: Look, this is the ruling; I myself practice coitus interruptus.
Imam Malik (may Allah have mercy on him) said: It is not permissible to practice coitus interruptus with a free woman without her permission, but it is permissible with one’s own slave-girl without her permission, and with someone else’s slave-girl, the permission of her owner is necessary.
