وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، أَنَّ سَعِيدَ بْنَ الْمُسَيَّبِ سُئِلَ عَنِ الْمَرْأَةِ يُطَلِّقُهَا زَوْجُهَا وَهِيَ فِي بَيْتٍ بِكِرَاءٍ، عَلَى مَنِ الْكِرَاءُ ؟ فَقَالَ
سَعِيدُ بْنُ الْمُسَيَّبِ :
" عَلَى زَوْجِهَا "، قَالَ : فَإِنْ لَمْ يَكُنْ عِنْدَ زَوْجِهَا ؟ قَالَ : " فَعَلَيْهَا "، قَالَ : فَإِنْ لَمْ يَكُنْ عِنْدَهَا ؟ قَالَ : " فَعَلَى الْأَمِيرِ "
It is narrated from Yahya ibn Sa'id that Sa'id ibn al-Musayyib was asked: If a woman is living in a rented house and her husband divorces her, who will pay the rent during the waiting period ('iddah)? Sa'id said: The husband will pay. He was asked: What if the husband does not have (the means)? Sa'id said: The wife will pay. He was asked: What if the wife also does not have (the means)? Sa'id said: The ruler will pay.
