وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
نَافِعٍ ، أَنَّ
عَبْدَ اللَّهِ بْنَ عُمَرَ ، كَانَ يَقُولُ :
" مَنْ أَذِنَ لِعَبْدِهِ أَنْ يَنْكِحَ، فَالطَّلَاقُ بِيَدِ الْعَبْدِ لَيْسَ بِيَدِ غَيْرِهِ مِنْ طَلَاقِهِ شَيْءٌ، فَأَمَّا أَنْ يَأْخُذَ الرَّجُلُ أَمَةَ غُلَامِهِ، أَوْ أَمَةَ وَلِيدَتِهِ، فَلَا جُنَاحَ عَلَيْهِ "
It is narrated from Nafi‘ that Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: Whoever gives his slave permission to marry, then the right of divorce will be in the hands of the slave, not anyone else. If a man takes away his slave’s slave-girl or her slave-girl and has intercourse with her, it is permissible.
