حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، أَنَّ عُرْوَةَ بْنَ الزُّبَيْرِ، كَانَ يَقُولُ فِي وَلَدِ الْمُلَاعَنَةِ، وَوَلَدِ الزِّنَا : " إِنَّهُ إِذَا مَاتَ وَرِثَتْهُ أُمُّهُ حَقَّهَا فِي كِتَابِ اللَّهِ تَعَالَى، وَإِخْوَتُهُ لِأُمِّهِ حُقُوقَهُمْ، وَيَرِثُ الْبَقِيَّةَ مَوَالِي أُمِّهِ إِنْ كَانَتْ مَوْلَاةً، وَإِنْ كَانَتْ عَرَبِيَّةً وَرِثَتْ حَقَّهَا، وَوَرِثَ إِخْوَتُهُ لِأُمِّهِ حُقُوقَهُمْ، وَكَانَ مَا بَقِيَ لِلْمُسْلِمِينَ .
Imam Malik, may Allah have mercy on him, said that Urwah bin Zubair used to say that when the child of li'an and the child of adultery die, their mother will inherit from them according to her share, and their maternal brothers will also inherit. Whatever remains will go to the mawla of the mother, if the mother was a slave woman who was set free. If she was a free Arab woman, then after giving the shares to the mother and brothers, whatever remains will go to the Bayt al-Mal.
