بَابُ مَا لَا يُبِينُ مِنَ التَّمْلِيكِWhat is not clarified in Tamlik (transfer of divorce right)
Hadith 1148
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّهُ قَالَ : " إِذَا مَلَّكَ الرَّجُلُ امْرَأَتَهُ، أَمْرَهَا فَلَمْ تُفَارِقْهُ، وَقَرَّتْ عِنْدَهُ، فَلَيْسَ ذَلِكَ بِطَلَاقٍ " .
Saeed bin Musayyib said: When a man gives his wife the authority to divorce, but the woman does not accept separation from her husband and wishes to remain with him, then the divorce will not take place.
