بَابُ نِكَاحِ الرَّجُلِ أُمَّ امْرَأَةٍ قَدْ أَصَابَهَا عَلَى وَجْهِ مَا يَكْرَهُMarriage of a man to his wife's mother whom he has had intercourse with in a disliked manner
Hadith 1097Q1
قَالَ مَالِكٌ : فِي الرَّجُلِ يَزْنِي بِالْمَرْأَةِ، فَيُقَامُ عَلَيْهِ الْحَدُّ فِيهَا. إِنَّهُ: يَنْكِحُ ابْنَتَهَا، وَيَنْكِحُهَا ابْنُهُ، إِنْ شَاءَ. وَذَلِكَ أَنَّهُ أَصَابَهَا حَرَامًا، وَإِنَّمَا الَّذِي حَرَّمَ اللّٰهُ مَا أُصِيبَ بِالْحَلَالِ، أَوْ عَلَى وَجْهِ الشُّبْهَةِ بِالنِّكَاحِ،
Imam Malik, may Allah have mercy on him, said: If a person commits adultery with a woman and the prescribed punishment is carried out on him, now that person can marry the mother or daughter of that woman, and that person's son can marry that woman.
