Hadith 1014

وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ قَالَ : " كَانَ عَلَيَّ مَشْيٌ فَأَصَابَتْنِي خَاصِرَةٌ، فَرَكِبْتُ حَتَّى أَتَيْتُ مَكَّةَ، فَسَأَلْتُ عَطَاءَ بْنَ أَبِي رَبَاحٍ وَغَيْرَهُ، فَقَالُوا : عَلَيْكَ هَدْيٌ فَلَمَّا قَدِمْتُ الْمَدِينَةَ، سَأَلْتُ عُلَمَاءَهَا، فَأَمَرُونِي أَنْ أَمْشِيَ مَرَّةً أُخْرَى مِنْ حَيْثُ عَجَزْتُ، فَمَشَيْتُ " .
Yahya ibn Sa'id said: I had made a vow to walk to the House of Allah, but I developed pain in my navel, so I rode to Mecca and asked 'Ata ibn Abi Rabah and others. They said: You are required to offer a sacrificial animal (hady). When I came to Madinah, I asked the people there, and they said: You must walk again from the place where you mounted (your ride). So I walked.
قَالَ يَحْيَى : وَسَمِعْتُ مَالِكًا، يَقُولُ : فَالْأَمْرُ عِنْدَنَا فِيمَنْ يَقُولُ عَلَيَّ مَشْيٌ إِلَى بَيْتِ اللَّهِ، أَنَّهُ إِذَا عَجَزَ رَكِبَ، ثُمَّ عَادَ فَمَشَى مِنْ حَيْثُ عَجَزَ، فَإِنْ كَانَ لَا يَسْتَطِيعُ الْمَشْيَ فَلْيَمْشِ مَا قَدَرَ عَلَيْهِ، ثُمَّ لِيَرْكَبْ وَعَلَيْهِ هَدْيُ بَدَنَةٍ أَوْ بَقَرَةٍ أَوْ شَاةٍ إِنْ لَمْ يَجِدْ إِلَّا هِيَ .
Imam Malik, may Allah have mercy on him, said: In our view, if a person says that he must walk to the House of Allah, and he starts walking but then becomes unable, he may ride. Then, when he returns again, he should walk from the place where he had started riding. If he does not have the strength to walk, then he should walk as far as he is able, then ride, and for the hady he should offer a camel or a cow; if he is unable, then a goat.
وَسُئِلَ مَالِك، عَنِ الرَّجُلِ، يَقُولُ لِلرَّجُلِ : أَنَا أَحْمِلُكَ إِلَى بَيْتِ اللَّهِ، فَقَالَ مَالِك : إِنْ نَوَى أَنْ يَحْمِلَهُ عَلَى رَقَبَتِهِ، يُرِيدُ بِذَلِكَ الْمَشَقَّةَ، وَتَعَبَ نَفْسِهِ فَلَيْسَ ذَلِكَ عَلَيْهِ، وَلْيَمْشِ عَلَى رِجْلَيْهِ، وَلْيُهْدِ وَإِنْ لَمْ يَكُنْ نَوَى شَيْئًا، فَلْيَحْجُجْ وَلْيَرْكَبْ، وَلْيَحْجُجْ بِذَلِكَ الرَّجُلِ مَعَهُ وَذَلِكَ، أَنَّهُ قَالَ : أَنَا أَحْمِلُكَ إِلَى بَيْتِ اللَّهِ فَإِنْ أَبَى أَنْ يَحُجَّ مَعَهُ فَلَيْسَ عَلَيْهِ شَيْءٌ، وَقَدْ قَضَى مَا عَلَيْهِ
Imam Malik (may Allah have mercy on him) was asked: If a person says to someone, "I will carry you to the House of Allah (the Ka'bah)," what is the ruling? Imam Malik (may Allah have mercy on him) replied: If his intention was that he would carry him on his own neck and by saying this he only meant to put himself in hardship, then in this case it is not obligatory upon him; rather, he should walk on foot and offer a sacrificial animal. And if he did not intend anything specific, then he should perform Hajj riding and also take that person with him for Hajj, because he said, "I will carry you to the House of Allah." However, if that person refuses to go with him, then nothing is obligatory upon him, because he has fulfilled his obligation.
قَالَ يَحْيَى : سُئِلَ مَالِك، عَنِ الرَّجُلِ يَحْلِفُ بِنُذُورٍ مُسَمَّاةٍ مَشْيًا إِلَى بَيْتِ اللَّهِ، أَنْ لَا يُكَلِّمَ أَخَاهُ أَوْ أَبَاهُ بِكَذَا وَكَذَا نَذْرًا لِشَيْءٍ لَا يَقْوَى عَلَيْهِ، وَلَوْ تَكَلَّفَ ذَلِكَ كُلَّ عَامٍ لَعُرِفَ أَنَّهُ لَا يَبْلُغُ عُمْرُهُ مَا جَعَلَ عَلَى نَفْسِهِ مِنْ ذَلِكَ، فَقِيلَ لَهُ : هَلْ يُجْزِيهِ مِنْ ذَلِكَ نَذْرٌ وَاحِدٌ أَوْ نُذُورٌ مُسَمَّاةٌ ؟ فَقَالَ مَالِك : مَا أَعْلَمُهُ يُجْزِئُهُ مِنْ ذَلِكَ إِلَّا الْوَفَاءُ بِمَا جَعَلَ عَلَى نَفْسِهِ، فَلْيَمْشِ مَا قَدَرَ عَلَيْهِ مِنَ الزَّمَانِ، وَلْيَتَقَرَّبْ إِلَى اللَّهِ تَعَالَى بِمَا اسْتَطَاعَ مِنَ الْخَيْرِ
Imam Malik (may Allah have mercy on him) was asked: If a person makes several vows that are impossible to fulfill in his entire lifetime, for example, "I will go to the House of Allah on foot," or "I will not speak to my father or brother," is it sufficient for him to fulfill one vow, or is it necessary to fulfill all the vows? Imam Malik (may Allah have mercy on him) replied: In my view, it is necessary to fulfill all the vows as much as possible and for as long as possible, and to seek closeness to Allah, Glorious and Exalted is He, through good deeds as much as one is able.
قَالَ مَالِكٌ : أَنَّ أَحْسَنَ مَا سَمِعْتُ مِنْ أَهْلِ الْعِلْمِ فِي الرَّجُلِ يَحْلِفُ بِالْمَشْيِ إِلَى بَيْتِ اللّٰهِ. أَوِ الْمَرْأَةِ. فَيَحْنَثُ أَوْ تَحْنَثُ. أَنَّهُ إِنْ مَشَى الْحَالِفُ مِنْهُمَا فِي عُمْرَةٍ فَإِنَّهُ يَمْشِي حَتَّى يَسْعَى بَيْنَ الصَّفَا وَالْمَرْوَةِ. فَإِذَا سَعَى فَقَدْ فَرَغَ. وَأَنَّهُ إِنْ جَعَلَ عَلَى نَفْسِهِ مَشْيًا فِي الْحَجِّ، فَإِنَّهُ يَمْشِي حَتَّى يَأْتِيَ مَكَّةَ. ثُمَّ يَمْشِي حَتَّى يَفْرُغَ مِنَ الْمَنَاسِكِ كُلِّهَا. وَلَا يَزَالُ مَاشِيًا حَتَّى يُفِيضَ.
Imam Malik, may Allah have mercy on him, said: I prefer what I have heard from the people of knowledge, that if a man or woman swears an oath to go to the Sacred Ka'bah on foot, then breaks that oath and it becomes obligatory for them to go to the Ka'bah on foot, then during 'Umrah, they should walk on foot until they have completed the Sa'i, and during Hajj, they should walk on foot until they have completed the Tawaf al-Ziyarah.
قَالَ مَالِكٌ : وَلَا يَكُونُ مَشْيٌ إِلَّا فِي حَجٍّ أَوْ عُمْرَةٍ.
Imam Malik, may Allah have mercy on him, said: A vow to walk applies only to two things: Hajj or Umrah.
