510- مالك عن يحيى بن سعيد عن أبى بكر بن محمد ابن عمرو بن حزم عن عمر بن عبد العزيز عن أبى بكر بن عبد الرحمن بن الحارث بن هشام عن أبى هريرة أن رسول الله صلى الله عليه وسلم قال: أيما رجل أفلس فأدرك الرجل ماله بعينه فهو أحق به من غيره.
It is narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, said: "If a man becomes insolvent (bankrupt) and another person finds his own property with him in its original form (exactly as it was), then he has more right to that property than others."

Jurisprudential Explanation: ➊ The meaning of the hadith is clear: if a person's property is with someone who has become bankrupt, then the original owner of the property may take back his property. ➋ To claim one’s right is a fundamental right of every Muslim. ➌ It is narrated from Sa‘id ibn al-Musayyib rahimahullah that a slave of Umm Habibah (radi Allahu anha) became bankrupt, so his case was brought before (Sayyiduna) ‘Uthman radi Allahu anhu. ‘Uthman (radi Allahu anhu) ruled that whoever took his right before the bankruptcy, it belongs to him, and whoever recognizes his goods, then it belongs to him.
