Hadith 41

502- مالك عن يحيى بن سعيد عن محمد بن يحيى بن حبان عن عمه واسع ابن حبان عن ابن عمر أنه كان يقول: إن ناسا يقولون: إذا قعدت على حاجتك فلا تستقبل القبلة ولا بيت المقدس. قال عبد الله بن عمر: لقد ارتقيت على ظهر بيت لنا، فرأيت رسول الله صلى الله عليه وسلم على لبنتين مستقبلا بيت المقدس لحاجته وقال: ”لعلك من الذين يصلون على أوراكهم“ فقلت: لا أدري والله، يعني الذى يسجد ولا يرتفع عن الأرض، يسجد وهو لاصق بالأرض.
Sayyiduna Ibn Umar (may Allah be pleased with them both) used to say that people say: If you sit for relieving yourself, then neither face the Qiblah nor Bayt al-Maqdis. Abdullah ibn Umar (may Allah be pleased with them both) said: I had climbed onto the roof of my house and saw that the Messenger of Allah (peace and blessings be upon him) was relieving himself facing Bayt al-Maqdis. Then he (Ibn Umar) said (to Wasi‘ ibn Hibban, may Allah have mercy on him): Perhaps you are among those people who pray on their buttocks? (Wasi‘ ibn Hibban, may Allah have mercy on him, said:) I said: By Allah! I do not know. (Imam Malik said:) That is, the person who prostrates but does not rise above the ground, rather he remains clinging to the ground while prostrating.

Understanding (Tafaqquh):
➊ In another chain of this hadith, it is mentioned that Sayyiduna Ibn Umar radi Allahu anhu said: «قاعدًا على لبنتين» That is, I saw the Prophet sallallahu alayhi wa sallam... he was sitting on two bricks. [صحيح بخاري : 149]
It is understood from this that relieving oneself (urinating, etc.) should be done while sitting. Note that if there is a valid Shar‘i excuse, then urinating while standing is also permissible; otherwise, it is prohibited. The Messenger of Allah sallallahu alayhi wa sallam said: «ثلاث من الجفاء : أن یبول الرجل قائمًا۔۔۔» Three things are from acts of injustice: (first) that a man urinates while standing... ● Sayyiduna Umar radi Allahu anhu said: Since I became Muslim, I have never urinated while standing. [كشف الاستار 1 / 130 ح244 وسنده صحيح]
➋ If climbing onto the roof does not violate the privacy of neighbors, and there is no fear of their displeasure or any Shar‘i opposition, then it is permissible to climb onto the roof of one’s own house even without their permission; otherwise, such an act is not permissible without permission.
➌ Clinging to the ground in the state of prostration (sujud) is not permissible.
