Hadith Authentication (Takhrij al-Hadith): [وأخرجه النسائي فى الكبريٰ تحفة الاشراف : 12119، من حديث مالك به وللحديث شواهد منها حديث البخاري 5601، ومسلم 1986، وبه صح الحديث]
Jurisprudential Explanation (Tafaqquh): ➊ Since every intoxicating substance is prohibited, and sometimes nabidh (a drink) made from dates and grapes can become intoxicating, therefore, as a preventive measure (sadd al-dhara’i) and to avoid doubt, making and drinking such nabidh (sherbet) has been prohibited. ➋ Islam is a religion that seeks the welfare of all humanity. ➌ What is meant by "thiqah" (trustworthy) in the mentioned narration? It is not clear, but in al-Sunan al-Kubra of al-Nasa’i, referenced in Tuhfat al-Ashraf 9/261, Hadith 12119, and in al-Tamhid 24/206, this same hadith has been narrated by ‘Amr ibn al-Harith (thiqah) from Bukayr ibn ‘Abdullah ibn al-Ashajj, and it also has authentic corroborating reports. Therefore, this hadith is authentic. «والحمدلله» ➍ Also see: [الموطأ 136، 248، مسلم 1997/48]
