387- وبه: أنها قالت: قدمت مكة وأنا حائض ولم أطف بالبيت ولا بين الصفا والمروة، فشكوت ذلك إلى رسول الله صلى الله عليه وسلم فقال: ”افعلي ما يفعل الحاج، غير أنك لا تطوفي بالبيت حتى تطهري.“
And with the same chain of narration, it is narrated from (Sayyida Aisha, may Allah be pleased with her) that when I came to Makkah, I was menstruating. I neither performed the Tawaf of the House of Allah nor the Sa'i between Safa and Marwah. Then I complained about this to the Messenger of Allah, peace and blessings be upon him, so he said: "Do what a pilgrim does, except that you should not perform the Tawaf of the House of Allah until you become pure."

Hadith Authentication (Takhrij al-Hadith): [وأخرجه البخاري 1650، من حديث مالك به]
Jurisprudential Points (Tafaqquh): ➊ It is not permissible to perform the circumambulation (tawaf) of the House of Allah (Baytullah) (and to perform sa’i between Safa and Marwah) in the state of menstruation (hayd). ➋ In matters of scholarly disagreement, one should refer back to the Book and the Sunnah. ➌ In the narration of Yahya ibn Yahya, it is mentioned: “and not to perform sa’i between Safa and Marwah.” Hafiz Ibn Abd al-Barr has considered this a mistake (wahm). See [التمهيد 19/261] ➍ Sayyiduna Abdullah ibn Umar radi Allahu anhu said: A menstruating woman, if she wishes, may recite the talbiyah for Hajj and ‘Umrah, but she will not perform the circumambulation (tawaf) of the House of Allah, nor will she perform sa’i between Safa and Marwah. She will perform all the rites of Hajj along with the people except that she will not perform the circumambulation of the House of Allah and the sa’i between Safa and Marwah, and she will not go near the mosque until she becomes pure.
