Hadith 325

425- وعن أبى النضر عن عمير مولى ابن عباس عن أم الفضل بنت الحارث: أن ناسا تماروا عندها يوم عرفة فى صيام رسول الله صلى الله عليه وسلم، فقال بعضهم: هو صائم، وقال بعضهم ليس بصائم. فأرسلت إليه أم الفضل بقدح لبن وهو واقف على بعيره بعرفة فشربه.
It is narrated from Sayyida Umm al-Fadl bint al-Harith (may Allah be pleased with her) that on the day of Arafat, the people differed regarding the fasting of the Messenger of Allah (peace and blessings be upon him). Some said: He is fasting, and some said: He is not fasting. Then Umm al-Fadl (may Allah be pleased with her) sent a bowl of milk to him, and he was standing on his camel in Arafat, so the Messenger of Allah (peace and blessings be upon him) drank it.

Jurisprudential Points:
➊ On the day of Arafah, the pilgrim should not fast. For other people, there is great virtue in fasting on this day. The Messenger of Allah (sallallahu alayhi wa sallam) said regarding the fast of Arafah: «يكفر السنة الماضيه والباقية» it becomes an expiation for the previous year and the coming year. [صحيح مسلم : 1162، دارالسلام : 2747]
➋ It is permissible to eat and drink while riding (on a mount).
➌ The people of truth may have differences among themselves in certain issues.
➍ It is permissible to perform Hajj while riding (on a mount), provided that it does not cause harm to others.
➎ Sayyidah Aisha Siddiqa (radi Allahu anha) used to fast on the day of Arafah. [الموطأ 1/375 ح853 وسنده صحيح]
➏ It is permissible to drink water and the like while standing. Sayyiduna Abdullah ibn Umar (radi Allahu anhu) said: We used to drink while standing... etc. [مسند أحمد 24/2 ح4765 وسنده حسن، و صححه ابن الجارود : 867 وابن حبان، الاحسان : 522٠، يزيد بن عطارد و ثقه ابن حبان وابن الجارد وفهو حسن الحديث وللحديث شاهد صحيح عند ابن حبان، الاحسان : 5301، دوسرا نسخه : 5325، موارد الظمآن : 1369، وسنن الترمذي : 1880، وقال : ”هذا حديث حسن صحيح غريب“]
◄ It is thus understood that the hadiths prohibiting drinking water while standing are either abrogated or pertain to disliked (tanzihi) status. And Allah knows best.
