464- وبه: أنها كانت تقول: إن كان رسول الله صلى الله عليه وسلم ليقبل بعض أزواجه وهو صائم، ثم تضحك.
And with the same chain of narration (it is narrated from Sayyidah Aisha, may Allah be pleased with her) that the Messenger of Allah, peace and blessings be upon him, used to kiss one of his wives while he was fasting. Then she (Aisha, may Allah be pleased with her) would laugh.

Jurisprudential Points: ➊ It is understood from this hadith that kissing one’s wife does not break the fast. ➋ The laughter indicates that the Prophet sallallahu alayhi wa sallam used to kiss his wife, Sayyidah Aisha radi Allahu anha. ➌ The Messenger of Allah sallallahu alayhi wa sallam loved his wife, Sayyidah Aisha radi Allahu anha, very much. ➍ Both Sayyiduna Abu Hurairah and Sayyiduna Sa’d ibn Abi Waqqas radi Allahu anhuma permitted kissing (one’s wife) while fasting. [المؤطا 292/1 ح655 و سنده صحيح] It is understood that this is a discretionary matter, meaning that an older person who can control his desires is permitted to kiss his wife while fasting. ➎ Sayyiduna Abdullah ibn Abbas radi Allahu anhu permitted kissing while fasting for the elderly and considered it disliked (makruh) for the young. [الموطأ 1/293 ح657 وسنده صحيح] ➏ Sayyiduna Abdullah ibn Umar radi Allahu anhu forbade the fasting person from kissing and lying with his wife. [الموطأ 1/293 ح658 وسنده صحيح] It is understood that for the general person, especially a young man, it is better that he does not kiss while fasting. And Allah knows best. ➐ Modesty and shyness should be observed at all times. ➑ For the purpose of expressing gratitude for blessings (tahdith al-ni’mah) and for the rectification of people, one’s own specific incident can be narrated when needed. ➒ The religion of Islam is easy and is the religion of nature (fitrah).
