383- مالك عن عبد الرحمن بن القاسم بن محمد بن أبى بكر الصديق عن عبد الله بن عبد الله بن عمر بن الخطاب أنه أخبره أنه كان يرى عبد الله بن عمر يتربع فى الصلاة إذا جلس، قال: ففعلته وأنا يومئذ حديث السن، فنهاني عبد الله بن عمر وقال: إنما سنة الصلاة أن تنصب رجلك اليمنى وتثني رجلك اليسرى، فقلت له: فإنك تفعل ذلك، فقال: إن رجلي لا تحملاني.
It is narrated from Ubaydullah bin Abdullah bin Umar bin al-Khattab, may Allah have mercy on him, that he used to see that (his father) Abdullah bin Umar, may Allah be pleased with them both, when he sat in prayer (for Tashahhud), he would sit cross-legged. He said that (once) I also did this, and at that time I was a small child, so Sayyiduna Abdullah bin Umar, may Allah be pleased with them both, forbade me and said: The Sunnah of prayer is that you should raise your right foot and spread your left foot. I said to him: But you sit cross-legged? He replied: My feet cannot support me, that is, I am ill.

Jurisprudential Points: ➊ If there is a legal excuse, such as illness, then sitting cross-legged (char zanu) in the position of tashahhud is permissible. ➋ Special attention should be given to the upbringing of young children so that they may learn faith and beliefs properly. ➌ A man was praying with Sayyiduna Ibn Umar radi Allahu anhu, and then that man sat cross-legged (char zanu) in tashahhud. When Ibn Umar radi Allahu anhu finished the prayer with salam, he did not approve of it, i.e., he forbade it. That person said: "Do you yourself not sit cross-legged?" So (Sayyiduna) Abdullah ibn Umar radi Allahu anhu replied: "I am ill." [الموطأ 89/1 ح196، وسنده صحيح] ● In another narration, he said regarding raising the feet on the chest: "This is not from the manner of prayer; I only do it because I am ill." [الموطأ 1/89 ح197، وسنده صحيح] ➍ According to the preferred opinion, when a Companion calls something a Sunnah, it is considered marfu‘, i.e., it is the Sunnah of the Prophet sallallahu alayhi wa sallam. See [الام للشافعي ج1 ص271، معرفة علوم الحديث للحاكم ص22، دوسرا نسخه ص156، اور اختصار علوم الحديث لابن كثير 1/150، نوع : 8] ◄ Al-Hakim al-Naysaburi says: «وقد أجمعوا عليٰ أن قول الصحابي سنة حديث مسند» and there is consensus on this, that when a Companion calls something a Sunnah, it is a musnad (marfu‘) hadith. [المستدرك 1/358 ح1323] ● There is some consideration regarding the claim of consensus, but this is the opinion of the majority, and this is the preferred view. ➎ It is incorrect to make an analogy from a state of necessity to a state of normalcy.
