بَابُ بَيَانِ أَنَّ صَاحِبَ الْمَالِ أَحَقُّ بِمَالِهِ عِنْدَ الْمُفْلِسِ إِذَا وَجَدَهُ بِعَيْنِهِ

Hadith 29
حَدَّثَنَا إِسْحَاقُ بْنُ مُوسَى الأَنْصَارِيُّ ، وَعَمْرُو بْنُ عَبْدِ اللَّهِ ، وَالْعَبَّاسُ بْنُ يَزِيدَ ، قَالُوا : حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ ، عَنْ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ وَجَدَ مَتَاعَهُ عِنْدَ رَجُلٍ قَدْ أَفْلَسَ بِعَيْنِهِ ، فَهُوَ أَحَقُّ بِهِ " .
It is narrated from Hazrat Abu Huraira (may Allah be pleased with him) that the Holy Prophet ﷺ said: "If a person finds his goods in their original state with an insolvent (bankrupt) person, then he has a greater right to that property."
