Disputes in business transactions explained
Hadith 892
أَخْبَرَنَا مُحَمَّدُ بْنُ بَكْرٍ، نا سَعِيدُ بْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، قَالَ: حَدَّثَنِي خِلَاسٌ، عَنْ أَبِي رَافِعٍ، عَنْ أَبِي هُرَيْرَةَ، فِي رَجُلَيْنِ تَدَارَا فِي بَيْعٍ وَلَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ، قَالَ: أَمَرَهُمَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ يَسْتَهِمَا عَلَى الْيَمِينِ أَحَبَّا ذَلِكَ أَمْ كَرِهَا.
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) regarding two men who disputed in a transaction, and neither of them had any proof. He narrated that the Messenger of Allah (peace and blessings be upon him) ordered both of them: "Let them draw lots to take an oath, whether they like it or dislike it."
Hadith 893
أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، نا مَعْمَرٌ، عَنْ هَمَّامِ بْنِ مُنَبِّهٍ، عَنْ أَبِي هُرَيْرَةَ، عَنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: ((إِذَا أُكْرِهَ الرَّجُلَانَ عَلَى الْيَمِينِ فَاسْتَحَبَّاهَا أُسْهِمَ بَيْنَهُمَا)).
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated from the Messenger of Allah (peace and blessings be upon him), he (peace be upon him) said: "When two men are compelled to take up (something), then drawing lots between them is a preferred act."
