Lady Fatimah bint Qais (may Allah be pleased with her) narrated: My husband divorced me three times during the time of the Messenger of Allah (peace and blessings be upon him), so I went to the Messenger of Allah (peace and blessings be upon him), and he did not assign me any residence or maintenance. Mughira narrated: I came to Ibrahim and mentioned this to him, and he said: She is entitled to residence and maintenance. I mentioned to him the statement of Shabi, and he said: Sayyiduna Umar (may Allah be pleased with him) used to assign this (residence and maintenance) for the divorced woman. Umar (may Allah be pleased with him) said: Because of the statement of one woman, we cannot leave the Book of our Lord and the Sunnah of our Prophet (peace and blessings be upon him); who knows, perhaps she remembered or perhaps she forgot.

It is narrated from Sayyida Fatimah bint Qais (may Allah be pleased with her) that she was divorced during the time of the Messenger of Allah (peace and blessings be upon him), so the Prophet (peace and blessings be upon him) did not assign her any residence or maintenance. And that Sayyiduna Umar (may Allah be pleased with him) said: "We cannot abandon the Book of our Lord and the Sunnah of our Prophet (peace and blessings be upon him) because of what a woman says; I do not know, perhaps she has forgotten."

So I went to the Messenger of Allah (peace and blessings be upon him) and mentioned this to him, and he (peace be upon him) said: "He has spoken the truth."

Abu Salamah narrated from Sayyidah Fatimah (may Allah be pleased with her): She said: I wrote the book by listening from her mouth.

Lady Fatimah bint Qais (may Allah be pleased with her) narrated: I was the wife of a man from the Banu Makhzum tribe, and he gave me an irrevocable divorce. I sent a message to his family and demanded maintenance from them, but they said: “You have no maintenance due from us.” The Messenger of Allah (peace and blessings be upon him) said: “There is no maintenance due to you from them, and you must observe the waiting period (‘iddah). Go to the house of Umm Sharik, and do not neglect to inform us when you make a decision regarding yourself.” Then he said: “At Umm Sharik’s house, the early emigrant Muslim brothers come and go. Go to the house of Ibn Umm Maktum, for he is a blind man; even if you take off your clothes, he will not see anything of you. And do not neglect to inform us when you make a decision regarding yourself.” She (Fatimah bint Qais, may Allah be pleased with her) said: Muawiyah bin Abi Sufyan and Abu Jahm al-Adawi (may Allah be pleased with them) both sent me marriage proposals. The Messenger of Allah (peace and blessings be upon him) said: “As for Muawiyah, he is a poor man and has nothing. As for Abu Jahm, he never puts his stick down from his shoulder (he is harsh-tempered). What do you think about Usamah bin Zaid (may Allah be pleased with him)?” Her family did not like him, but she said: “I will marry the one to whom the Messenger of Allah (peace and blessings be upon him) has invited me.” So I married Usamah bin Zaid (may Allah be pleased with him).

Sayyiduna Ibn Abbas (may Allah be pleased with them both) said regarding Allah Almighty’s statement: «لَاتُخْرِجُوهُنَّمِنبُيُوتِهِنَّوَلَايَخْرُجْنَإِلَّاأَنيَأْتِينَبِفَاحِشَةٍمُّبَيِّنَةٍ» “Do not drive them out of their houses, nor should they leave, unless they commit a clear indecency.” In its explanation, he said: «وَالْفَاحِشَةٍمُّبَيِّنَةٍ» This means that she becomes a cause of disgrace for her family, so when she does this, it becomes lawful for them to expel her.

Fatimah bint Qais (may Allah be pleased with her), the sister of Dhahhak bin Qais (may Allah be pleased with him), narrated: She was the wife of a man from the Banu Makhzum tribe. He gave her three divorces and himself went out on a military expedition, and he told his agent to give her some maintenance. So I considered it insufficient, and I went to one of the wives of the Prophet (peace and blessings be upon him). The Prophet (peace and blessings be upon him) came while she was with her. She said: O Messenger of Allah! This is Fatimah bint Qais. So-and-so has given her three divorces, and he has ordered a small amount of maintenance for her, but she did not accept it, and he said that even this is a favor upon her. The Messenger of Allah (peace and blessings be upon him) said: "He has spoken the truth." And he (peace and blessings be upon him) said to her: "Go to Umm Maktum and spend your waiting period with her." Then he said: "She is a woman with many visitors. Go to Abdullah ibn Umm Maktum and spend your waiting period with him." So I went to Abdullah ibn Umm Maktum and spent my waiting period with him. When my waiting period ended, Abu Jahm bin Hudhayfah and Muawiyah bin Abi Sufyan (may Allah be pleased with them both) sent me proposals of marriage. I consulted the Messenger of Allah (peace and blessings be upon him) about it, so the Messenger of Allah (peace and blessings be upon him) said: "As for Abu Jahm bin Hudhayfah, he is a man who carries a stick, so you may fear being beaten, and as for Muawiyah, he is poor and has no wealth." So Usamah bin Zaid (may Allah be pleased with him) married her.

It is narrated from Ubaidullah bin Abdullah that Abu Amr bin Hafs bin Mughira set out towards Yemen with Ali bin Abi Talib, so he sent the final divorce to Fatimah bint Qais (may Allah be pleased with her) and told Harith bin Hisham and Ayyash bin Abi Rabi’ah to give her maintenance. So both of them said to her: By Allah! You are not entitled to maintenance unless you are pregnant. So she came to the Prophet (peace and blessings be upon him) and mentioned this to him, so he (peace be upon him) said: “There is no maintenance for you, so spend your waiting period (‘iddah) at the house of Ibn Umm Maktum, as he is blind. You may even remove your clothes in his presence, and he will not be able to see you.” So when she completed her ‘iddah, the Messenger of Allah (peace and blessings be upon him) married her to Usamah bin Zaid (may Allah be pleased with him). The news of this reached Marwan, so he sent Qabeesah bin Dhuwayb to her to ask her about this hadith, and she narrated it to him. So Marwan said: This hadith has only been heard from one woman; we will only follow the path upon which we found the people. When Lady Fatimah (may Allah be pleased with her) heard Marwan’s statement, she said: Between me and you is the Qur’an (as evidence). Allah, the Mighty and Majestic, has said in His Book: “They should not leave (their houses) unless they commit a clear/manifest indecency.” Perhaps after that Allah will bring about some (other) way. So it was said: This is for the one who has the right to take her back; after three divorces, what way will be brought about? He is not obliged to spend on you unless you are pregnant, so on what basis will they prevent her?

Maymun bin Mehran narrated: I asked Sa'id bin al-Musayyib, may Allah have mercy on him, about a woman divorced thrice: where should she observe her waiting period ('iddah)? He said: In her husband's house. So I said to him: What about the hadith of Fatimah bint Qais, may Allah be pleased with her? He said: That woman has put people to trial; she was ill-mannered, or he said: She was a woman who did not treat her husband's relatives well.

Maimun bin Mehran narrated: I came to Madinah Munawwarah and inquired about the greatest jurist there, so I was sent to Saeed bin Musayyib, may Allah have mercy on him. I asked him about a woman who has been given three divorces: where should she spend her waiting period (‘iddah)? He said: In her husband's house. I said: Fatimah bint Qais, the sister of Dhahhak bin Qais (may Allah be pleased with him), was given three divorces by her husband, so she spent her ‘iddah at the house of Ibn Umm Maktum (may Allah be pleased with him). He replied: That woman had bad manners, so she was made to stay at the house of Ibn Umm Maktum (may Allah be pleased with him).
