Book of Jihad

It is not permissible to punish with fire; apostates are to be killed

Hadith 535
اَخْبَرَنَا سُفْیَانُ، عَنْ اَیُّوْبَ، عَنْ عِکْرَمَةَ،عَنِ ابْنِ عَبَّاسٍ اَنَّهٗ ذَکَرَ نَاسًا اَحْرَقَهُمْ عَلِیٌّ فَقَالَ: لَوْ کُنْتُ اَنَا لَمْ اُحَرِّقْهُمْ، لِاَنَّ رَسُوْلَ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ قَالَ: لَا تُعَذِّبُوْا بِعَذَابِ اللّٰهِ، وَلَقَتَلْتُهُمْ، لِاَنَّ رَسُوْلَ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ قَالَ: مَنْ بَدَّلَ دِیْنَهٗ فَاقْتُلُوْهٗ.
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that he mentioned some people whom Sayyiduna Ali (may Allah be pleased with him) had burned, so he said: If I had been there, I would not have burned them, because the Messenger of Allah (peace and blessings be upon him) said: "Do not punish anyone with Allah's punishment (i.e., fire)." And I would certainly have killed them, and also because the Messenger of Allah (peace and blessings be upon him) said: "Whoever changes his religion, kill him."
