Hadith 476
أَخْبَرَنَا عِيسَى بْنُ يُونُسَ، نا سَعِيدُ بْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنِ النَّضْرِ بْنِ أَنَسٍ، عَنْ بَشِيرِ بْنِ نَهِيكٍ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، عَنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: مَنْ أَعْتَقَ شِقْصًا فِي مَمْلُوكٍ فَعَلَيْهِ خَلَاصُهُ فِي مَالِهِ إِنْ كَانَ لَهُ مَالٌ فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ، قُوِّمَ الْعَبْدُ قِيمَةَ عَدْلٍ، ثُمَّ يُسْتَسْعَى فِي نَصِيبِ الَّذِي لَمْ يُعْتِقْ غَيْرَ مَشْقُوقٍ عَلَيْهِ.
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated from the Messenger of Allah (peace and blessings be upon him), he (peace be upon him) said: "Whoever frees his share in a jointly owned slave, it is obligatory upon him that if he has wealth, he should grant the slave complete freedom from his own wealth. And if he does not have wealth, then the value of the slave should be assessed justly, then regarding the share which has not been freed, the slave should be told to strive to earn and obtain his freedom himself, but no hardship should be imposed upon him."
Hadith Q477
Urwah narrated from this chain the same narration, and said: Regarding the share of the partner who did not free him: The slave will be told to earn and obtain his freedom himself.
Hadith 477
أَخْبَرَنَا عَبْدَةُ بْنُ سُلَيْمَانَ، عَنِ ابْنِ أَبِي عَرُوبَةَ، بِهَذَا الْإِسْنَادِ مِثْلَهُ، وَقَالَ: يُسْتَسْعَى فِي نَصِيبِ صَاحِبِهِ الَّذِي لَمْ يُعْتِقْهُ.
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated from the Messenger of Allah (peace and blessings be upon him), he (peace be upon him) said: "If he has wealth, he will be freed from his wealth; if he does not have wealth, the slave will earn and obtain freedom."
