A partner has the right of preemption (shuf’ah)
Hadith 465
اَخْبَرَنَا جَرِیْرٌ، عَنْ عَبْدِالْعَزِیْزِ بْنِ رَفِیْعٍ، عَنِ ابْنِ اَبِیْ مُلَیْکَةَ، قَالَ: قَالَ رَسُوْلُ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ: اَلشَّرِیْكُ شَفِیْعٌ، وَالشُّفْعَةُ فِیْ کُلِّ شَیْئٍ۔ فَقَالَ عَطَاءٌ: اِنَّمَا ذٰلِكَ فِی الْاَرْضِ، فَقَالَ ابْنُ اَبِیْ مُلَیْکَةَ: لَا اَمْ، وَمَا یُدْرِكَ.
Ibn Abi Mulaykah narrated that the Messenger of Allah, peace and blessings be upon him, said: "A partner is a mediator (has the right of pre-emption), and pre-emption is in everything." Ata, may Allah have mercy on him, said: It (pre-emption) is only in land, so Ibn Abi Mulaykah said: No, what do you know?
Hadith 466
اَخْبَرَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، نَا شُعْبَةُ، نَا عَبْدِالْعَزِیْزِ بْنِ رَفِیْعٍ قَالَ: سَمِعْتُ ابْنَ اَبِیْ مُلَیْکَةَ یَقُوْلُ: قَالَ رَسُوْلُ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ اَلشُّفْعَةُ فِی الْعَبْدِ، وَفِیْ کُلِّ شَیْئٍ.
Ibn Abi Mulaykah narrates that the Messenger of Allah, peace and blessings be upon him, said: "Pre-emption applies to a slave and to everything."
Hadith 467
اَخْبَرَنَا الْفَضْلُ بْنُ مُوْسٰی، نَا اَبُوْ حَمْزَةَ السَّکَرِیُّ، عَنْ عَبْدِالْعَزِیْزِ بْنِ رَفِیْعٍ، عَنْ ابْنِ اَبِیْ مُلَیْکَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنْ رَّسُوْلِ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ یَقُوْلُ: اَلشَّرِیْكُ شَفِیْعٌ، وَالشُّفْعَةُ فِیْ کُلِّ شَئْیٍٔ.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrated from the Messenger of Allah (peace and blessings be upon him), he (peace be upon him) said: "The partner has the right of pre-emption, and pre-emption is in everything."
