Hadith 951

أَخْبَرَنَا كَثِيرُ بْنُ هِشَامٍ، نا جَعْفَرُ بْنُ بُرْقَانَ، نا يَزِيدُ بْنُ الْأَصَمِّ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ: ((مَا مِنْ دَابَّةٍ فِي الْأَرْضِ وَلَا طَائِرٍ يَطِيرُ بِجَنَاحَيْهِ إِلَّا سَيُحْشَرُ يَوْمَ الْقِيَامَةِ، ثُمَّ يُقْتَصُّ لِبَعْضِهَا مِنْ بَعْضٍ حَتَّى يُقْتَصَّ لِلْجَمَّاءِ مِنْ ذَاتِ الْقَرْنِ، فَعِنْدَ ذَلِكَ يَقُولُ الْكَافِرُ يَا لَيْتَنِي كُنْتُ تُرَابًا)) ، ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ: " فَاقْرَءُوا إِنْ شِئْتُمْ: ﴿وَمَا مِنْ دَابَّةٍ فِي الْأَرْضِ وَلَا طَائِرٍ يَطِيرُ بِجَنَاحَيْهِ إِلَّا أُمَمٌ أَمْثَالُكُمْ مَا فَرَّطْنَا فِي الْكِتَابِ مِنْ شَيْءٍ ثُمَّ إِلَى رَبِّهِمْ يُحْشَرُونَ﴾ [الأنعام: 38] .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated: Every creature that walks on the earth and every bird that flies with its wings will be gathered on the Day of Resurrection, then retribution will be taken among them, so much so that the hornless goat will be compensated by the horned goat. Then the disbeliever will say: "Would that I were dust!" Then Abu Hurairah (may Allah be pleased with him) said: If you wish, recite this verse: "There is no creature that moves on the earth nor a bird that flies with its wings but are communities like you. We have neglected nothing in the Book, then unto their Lord they will be gathered."

From the mentioned hadith, it is understood that on the Day of Resurrection, even animals will be given retribution, just as those who are legally responsible among humans, children, and the insane will be resurrected. In the same way, animals will also be brought back to life and retribution (qisas) will be taken from them.

Mulla Ali Qari rahimahullah has written in (Mirqat al-Mafatih: 4/761): If it is objected that the goat is not legally responsible (ghayr mukallaf), so how can retribution (qisas) be taken from it? Then we say: Indeed, Allah Ta'ala does whatever He wills; He cannot be questioned about what He does. The purpose of taking retribution from animals is to make people aware of this reality: that rights will not be wasted, and in every situation, the oppressed will be given retribution from the oppressor. The aforementioned narration also refutes the interpretations of those who do not believe in the actual gathering of animals and the taking of retribution from them.
