Hadith 895

أَخْبَرَنَا الْمُغِيرَةُ بْنُ سَلَمَةَ الْمَخْزُومِيُّ، نا وُهَيْبٌ، عَنْ خَالِدٍ الْحَذَّاءِ، عَنْ يُوسُفَ بْنِ عَبْدِ اللَّهِ بْنِ الْحَارِثِ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، عَنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: ((إِذَا اخْتَلَفَ النَّاسُ فِي الطَّرِيقِ فَاجْعَلُوهُ عَلَى سَبْعَةِ أَذْرُعٍ)) .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated from the Messenger of Allah (peace and blessings be upon him), he (peace and blessings be upon him) said: "When people disagree about the path, then fix it at seven handspans."

From the mentioned hadith, it is understood that when partners dispute over the width of a pathway, then that width will be seven cubits (i.e., seven hand-spans). By "hand," what is meant is the distance from the fingertips to the elbow, which is equivalent to two spans, that is, eight finger-widths or one and a half feet. The measurement of seven cubits is equal to three and a half yards or ten and a half feet, but seven feet is the minimum. In the present era, since there are cars, buses, etc., the limit should be set according to their requirements. Therefore, when preparing the plans for new colonies, the width should be kept as much as possible; if not, then at least seven hand-spans.

Similarly, Ibn Hajar al-Asqalani rahimahullah said: Those shopkeepers who sit on the pathway, it is necessary for them that if the pathway is more than seven hand-spans wide, they should leave seven hand-spans and sit in the remaining part. If they sit within the seven hand-spans, then they should be prevented so that passersby are not inconvenienced.
