Hadith 639

اَخْبَرَنَا عَبْدُاللّٰهِ بْنُ نُمَیْرٍ، عَنْ اِسْمَاعِیْلَ بْنِ مُسْلِمٍ، عَنْ عَمْرِو بْنِ دِیْنَارٍ، عَنْ طَاؤُوْسٍ، عَنِ ابْنِ عَبَّاسٍ اَنَّ رَجُلًا ظَاهَرَ مِنْ اِمْرَأَتِهٖ، ثُمَّ رَاٰهَا فِی الْقَمَرِ، فَاَعْجَبَتْهٗ فَوَقَعَ عَلَیْهَا، فَاَتَی رَسُوْلُ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ، فَاخْبَرَهٗ فَقَالَ: اَلَیْسَ قَالَ اللّٰهُ عَزَّوَجَلَّ ﴿مِنْ قَبْلِ اَنْ یَّتَمَاسَّا﴾ فَقَالَ: رَأَیْتُهَا فَاَعْجَبَتْنِیْ، فَقَالَ: اَمْسِكْ حَتّٰی تُکَفِّرَ.
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that a man (Salamah bin Sakhr) pronounced zihar upon his wife (said to her: "You are to me like the back of my mother"), then he saw her in the moonlight, she pleased him, so he had intercourse with her. Then he came to the Messenger of Allah (peace and blessings be upon him) and informed him, so the Prophet (peace and blessings be upon him) said: "Did Allah, the Mighty and Majestic, not say: 'Before they touch each other'?" He replied: "I saw her and she pleased me." The Prophet (peace and blessings be upon him) said: "Refrain until you have offered the expiation."

Benefits:
From the mentioned hadith, it is understood that intercourse is not permissible before offering the expiation (kaffarah) in the case of zihar. Zihar is: ((ANTA ‘ALAYYA KA ZAHRI UMMI)) (Al-Qamus Al-Muheet, p. 392) “You are to me like the back of my mother.”

Imam Shawkani rahimahullah states: Before offering the expiation, intercourse is forbidden for the husband, and there is consensus (ijma‘) on this. The expiation is obligatory upon him, and having intercourse before offering the expiation does not absolve him of the obligation to offer the expiation.
