Hadith 638

أَخْبَرَنَا وَكِيعٌ، نا جَعْفَرُ بْنُ بُرْقَانَ، عَنْ مَيْمُونِ بْنِ مِهْرَانَ قَالَ: أَتَيْتُ الْمَدِينَةَ، فَسَأَلْتُ عَنْ أَفْقَهِ أَهْلِهَا، فَدُفِعْتُ إِلَى سَعِيدِ بْنِ الْمُسَيِّبِ، فَسَأَلْتُهُ عَنِ الْمُطَلَّقَةِ ثَلَاثًا، أَيْنَ تَعْتَدُّ؟ فَقَالَ: ((فِي بَيْتِ زَوْجِهَا)) ، قُلْتُ: فَإِنَّ فَاطِمَةَ بِنْتَ قَيْسٍ أُخْتَ الضَّحَّاكِ بْنِ قَيْسٍ طَلَّقَهَا زَوْجُهَا ثَلَاثًا، فَاعْتَدَّتْ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ، فَقَالَ: ((تِلْكَ امْرَأَةٌ لَسِنَةٌ، فَوُضِعَتْ عَلَى يَدَيِ ابْنِ أُمِّ مَكْتُومٍ)).
Maimun bin Mehran narrated: I came to Madinah Munawwarah and inquired about the greatest jurist there, so I was sent to Saeed bin Musayyib, may Allah have mercy on him. I asked him about a woman who has been given three divorces: where should she spend her waiting period (‘iddah)? He said: In her husband's house. I said: Fatimah bint Qais, the sister of Dhahhak bin Qais (may Allah be pleased with him), was given three divorces by her husband, so she spent her ‘iddah at the house of Ibn Umm Maktum (may Allah be pleased with him). He replied: That woman had bad manners, so she was made to stay at the house of Ibn Umm Maktum (may Allah be pleased with him).
