أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، أنا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، أَنَّ أَبَا عَمْرِو بْنَ حَفْصِ بْنِ الْمُغِيرَةِ خَرَجَ مَعَ عَلِيِّ بْنِ أَبِي طَالِبٍ إِلَى الْيَمَنِ، فَأَرْسَلَ إِلَى فَاطِمَةَ بِنْتِ قَيْسٍ بِتَطْلِيقَةٍ، كَانَتْ بَقِيَ مِنْ طَلَاقِهَا، وَأَمَرَ لَهَا الْحَارِثُ بْنُ هِشَامٍ وَعَيَّاشُ بْنُ أَبِي رَبِيعَةَ بِنَفَقَةٍ، فَقَالَا لَهَا: وَاللَّهِ مَا لَكِ مِنْ نَفَقَةٍ إِلَّا أَنْ تَكُونِي حُبْلَى، فَأَتَتِ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهُ، فَقَالَ: ((لَا نَفَقَةَ لَكِ، فَاعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ)) ، وَهُوَ أَعْمَى تَضَعُ ثِيَابَهَا عِنْدَهُ وَلَا يَرَاهَا، فَلَمَّا انْقَضَتْ عِدَّتُهَا أَنْكَحَهَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أُسَامَةَ بْنَ زَيْدٍ، فَبَلَغَ ذَلِكَ مَرْوَانَ، فَأَرْسَلَ قَبِيصَةَ بْنَ ذُؤَيْبٍ إِلَيْهَا يَسْأَلُهَا عَنْ هَذَا الْحَدِيثِ، فَحَدَّثْتُهُ، فَقَالَ مَرْوَانُ: لَمْ نَسْمَعْ بِهَذَا الْحَدِيثِ إِلَّا مِنَ امْرَأَةٍ سَنَأْخُذُ بِالْعِصْمَةِ الَّتِي وَجَدْنَا النَّاسَ عَلَيْهَا، فَبَلَغَ فَاطِمَةُ قَوْلَ مَرْوَانَ، فَقَالَتْ: بَيْنِي وَبَيْنَكُمُ الْقُرْآنُ، قَالَ اللَّهُ عَزَّ وَجَلَّ فِي كِتَابِهِ: ﴿وَلَا يَخْرُجْنَ﴾ [الطلاق: 1] مِنْ بُيُوتِهِنَّ ﴿إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ﴾ [النساء: 19] حَتَّى بَلَغَ: ﴿لَعَلَّ اللَّهَ يُحْدِثُ بَعْدَ ذَلِكَ أَمْرًا﴾ [الطلاق: 1]فَقَالَتْ: هَذَا لِمَنْ كَانَ لَهُ رَجْعَةٌ عَلَيْهَا، فَأَيُّ أَمْرٍ يَحْدُثُ بَعْدَ الثَّلَاثِ؟ فَكَيْفَ تُنْفِقُونَ عَلَيْهَا إِلَّا أَنْ تَكُونَ حُبْلَى؟ فَعَلَى مَا يَحْبِسُونَهَا.
It is narrated from Ubaidullah bin Abdullah that Abu Amr bin Hafs bin Mughira set out towards Yemen with Ali bin Abi Talib, so he sent the final divorce to Fatimah bint Qais (may Allah be pleased with her) and told Harith bin Hisham and Ayyash bin Abi Rabi’ah to give her maintenance. So both of them said to her: By Allah! You are not entitled to maintenance unless you are pregnant. So she came to the Prophet (peace and blessings be upon him) and mentioned this to him, so he (peace be upon him) said: “There is no maintenance for you, so spend your waiting period (‘iddah) at the house of Ibn Umm Maktum, as he is blind. You may even remove your clothes in his presence, and he will not be able to see you.” So when she completed her ‘iddah, the Messenger of Allah (peace and blessings be upon him) married her to Usamah bin Zaid (may Allah be pleased with him). The news of this reached Marwan, so he sent Qabeesah bin Dhuwayb to her to ask her about this hadith, and she narrated it to him. So Marwan said: This hadith has only been heard from one woman; we will only follow the path upon which we found the people. When Lady Fatimah (may Allah be pleased with her) heard Marwan’s statement, she said: Between me and you is the Qur’an (as evidence). Allah, the Mighty and Majestic, has said in His Book: “They should not leave (their houses) unless they commit a clear/manifest indecency.” Perhaps after that Allah will bring about some (other) way. So it was said: This is for the one who has the right to take her back; after three divorces, what way will be brought about? He is not obliged to spend on you unless you are pregnant, so on what basis will they prevent her?
