Hadith 612

اَخْبَرَنَا وَکِیْعَ، نَا زَکَرِیَّا، عَنِ الشَّعْبِیِّ، قَالَ: اَفْتٰی اَبُوْ سَلْمَةَ بْنُ عَبْدِالرَّحْمٰنِ، وَابْنُ عَبَّاسٍ فِی الْمُتَوَفّٰی عَنْهَا زَوْجُهَا، فَاَرْسِلُوْا اِلٰی اُمِّ سَلِمَةَ فَسَأَلُوْهَا عَنْ ذٰلِكَ، فَقَالَتْ: وَضَعَتْ سُبَیْعَةُ بَعْدَ وَفَاةِ زَوْجِهَا شَهْرًا وَنَحْوَهُ، فَلَمَّا وَلَدَتْ وَتَطَهَّرَتْ، قَالَ لَهَا رَسُوْلُ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ: انْکَحِیْ مَنْ شِئْتِ وَلَمْ یَقُلْ: آخِرَ الْاَجَلَیْنِ.
Shu’bi (may Allah have mercy on him) said: Abu Salamah bin Abdur Rahman and Ibn Abbas (may Allah be pleased with them both) gave a fatwa regarding a woman whose husband passes away, so they sent a message to Umm Salamah (may Allah be pleased with her) and asked her about this matter. She said: Subai’ah gave birth to a child about a month after her husband’s death. So when she gave birth and became pure (from postpartum bleeding), the Messenger of Allah (peace and blessings be upon him) said to her: “You may marry whomever you wish.” The Prophet (peace and blessings be upon him) did not say: Complete whichever of the two periods is longer.
