In another hadith, it is mentioned that Sayyiduna Hanzalah bin Qais Al-Ansari says: I asked Sayyiduna Rafi’ bin Khadij radi Allahu anhu about giving land on rent in exchange for gold or silver. He said: There is no harm in it. In fact, during the time of the Messenger of Allah sallallahu alayhi wa sallam, people used to do it in such a way that they would make an agreement on whatever was on the flow of water and at the heads of the canals, and on some crops. Then it would happen that this (portion) would be ruined and that (portion) would remain, or that (portion) would be ruined and this (portion) would remain. Among the people, this was the only method of renting out land that was prevalent, due to which the Prophet sallallahu alayhi wa sallam strictly forbade and stopped them from this transaction. But as for the compensation and return that is known and specified, there is no harm in it. (Muslim, Kitab al-Buyu’, no. 1547; Sunan Abi Dawud, no. 3392)
It is understood from this that it is permissible to lease land in exchange for cash or a known profit. The prohibition mentioned in the above narration refers to the yield of a specific portion, as people used to do in the Prophetic era, and this would result in loss—sometimes to the lessee and sometimes to the actual owner of the land, which would lead to disputes and quarrels. Therefore, the Noble Prophet sallallahu alayhi wa sallam forbade doing so. Thus, if land is leased for a specified yield, gold, silver, or cash, etc., then there is no harm in it.
