Hadith 439

اَخْبَرَنَا عَبْدُالرَّزَّاقِ، نَا مَعْمَرٌ عَنِ ابْنِ طَاؤُوْسٍ، عَنْ اَبِیْهِ، عَنِ ابْنِ عَبَّاسٍ، عَنْ رَسُوْلِ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ اَنَّه نَهٰی اَنْ یَّبِیْعَ حَاضِرٌ لِبَادٍ، قَالَ: فَقُلْتُ لِابْنِ عَبَّاسٍ: مَا قَوْلُهٗ: لَا یَبِیْعُ حَاضِرٌ لِبَادٍ؟ قَالَ: لَا یَکُنْ لَهٗ سِمْسَارًا.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrated from the Messenger of Allah (peace and blessings be upon him) that he (peace be upon him) forbade that a townsman should sell on behalf of a villager. The narrator said: I asked Sayyiduna Ibn Abbas (may Allah be pleased with them both): What is meant by your statement, "A townsman should not sell on behalf of a villager"? He replied: That he should not become his agent (broker).

Benefits:
In the aforementioned hadith, it is stated that no townsman should sell the goods of a villager. Imam Nawawi rahimahullah says: According to our companions, what is meant by this is that a stranger (villager) brings such goods from another town or village, which are needed by everyone, to sell at the current day's price. However, a townsman says to him, "Leave this merchandise with me so that I may sell it gradually at a higher price." (Sharh Muslim by Nawawi: 5/425)

Some say that a townsman meets the villager on the way before he reaches the city market, so that by misrepresenting the prices, he buys the goods from him at a cheap rate and acquires them for less than their actual value. The Shariah has prohibited this so that the seller may be protected from deception and harm. However, if a townsman sells the villager's goods without commission and without any greed, then according to Imam Bukhari rahimahullah, this is permissible. As he has established a chapter in his Sahih: ((Chapter: Can a townsman sell for a villager without a fee? And can he assist him or advise him?)) (Bukhari, Book of Sales: Chapter 68).... "Can a townsman sell the goods of a villager without any compensation?" And can he help him or give him advice?

And the noble Prophet sallallahu alayhi wa sallam's statement is mentioned along with this: ((When any one of you is asked for advice by his brother, he should advise him.)).... "When any person seeks goodwill from his brother, he should give him sincere advice."

In the above-mentioned hadith, it is stated that no one should sell over the sale of another, nor propose over the proposal of another, and no woman should demand the divorce of her sister. (See for this the explanation of Hadith number 155)

If an animal is bought and needs to be returned, then a sa‘ (a specific measure) should be given along with it. (See further the explanation of Hadith number 62)
