اَخْبَرَنَا مُحَمَّدُ بْنُ بَکْرٍ، اَنَا ابْنُ جُرَیْجٍ، اَخْبَرَنِیْ عَطَاءٌ، قَالَ: کَانَ ابْنُ عَبَّاسٍ یَقُوْلُ: لَا یَطُوْفُ بِالْبَیْتِ حَاجَّ وَلَا غُیْرُ حَاجٍّ اِلَّا حِلّ۔ قُلْتُ لِعَطَاءٍ: مَنْ اَیْنَ یَقُوْلُ ذٰلِكَ؟ قَالَ: مَنْ قَوْلِ اللّٰهِ عَزَّوَجَلَّ: ﴿ثُمَّ مَحِلُّهَا اِلَی الْبَیْتِ الْعَتِیْقِ﴾ قُلْتُ: فَاِنَّ ذٰلِکَ بَعْدَ الْمَصْرَفِ، فَقَالَ: کَانَ ابْنُ عَبَّاسٍ یَقُوْلُ: هُوَ بَعْدَ الْمَصْرَفِ وَقَبْلِهٖ، وَکَانَ یَأْخُذُ ذٰلِکَ مِنْ اَمْرِ النَّبِیِّ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ حِیْنَ اَمَرَهُمْ اَنْ یَحَلُّوْا فِی حَجَّةِ الْوِدَاعِ، قَالَهَا غَیْرَ مَرَّةْ.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) used to say: Whoever performs Tawaf of the House of Allah, whether he is performing Hajj or not, becomes free from the restrictions of Ihram. The narrator says: I asked Ata: On what basis did he say this? He replied: On the basis of Allah’s statement «ثُمَّ مَحِلُّهَا إِلَى الْبَيْتِ الْعَتِيقِ». I asked: Is this after returning from there? He said: Ibn Abbas (may Allah be pleased with them both) used to say: It is both before and after returning, and he also said this on the basis of the statement of the Prophet (peace and blessings be upon him), because on the occasion of Hajjatul Wada’, the Prophet (peace and blessings be upon him) told the companions to come out of the state of Ihram, and he said this several times.
