Hadith 377

اَخْبَرَنَا الْفَضْلُ بْنُ مُوْسٰی، نَا طَلْحَةُ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، اَنَّ رَسُوْلَ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ لَمَّا خَرَجَ مِنْ مَّکَةَ قَالَ: اِنَّكِ لَاحَبُّ بِلَادِ اللّٰهِ اِلَی اللّٰهِ، وَلَوْلَا اَنَّ قَوْمَكِ اَخْرَجُوْنِیْ مَا خَرَجْتُ، یَا بَنِیْ عَبْدِ مَنَافٍ: اِنْ وُلِّیْتُمْ مِنْ هَذَا الْاَمْرِ شَیْئًا، فَـلَا تَمْنَعُوْا طَائِفًا یَطُوْفُ بِالْبَیْتِ سَاعَةً مِّنْ لَیْلٍ اَوْ نَهَارٍ، وَلَوْلَا اَنْ تَبَطَّرَ قُرَیْشٌ لَاَخْبَرْتُهَا بِمَا لَهَا عِنْدَ اللّٰهِ اَللّٰهُمَّ کَمَا رَزَقْتَنَا (رَزَقْتَ أَوَّلَهُمْ فَأَذِقْ آخِرَهُمْ نَوَالًا).
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that when the Messenger of Allah (peace and blessings be upon him) departed from Makkah, he said: "Indeed, you are the most beloved of Allah's cities to Allah, and if your inhabitants had not expelled me, I would not have left. O Banu Abd Manaf! If you are granted guardianship over it, then do not prevent any circumambulator at any time of the day or night. If it were not that the Quraysh would become boastful, I would have informed them of the status that is theirs with Allah regarding this place. O Allah! Just as You have provided us with sustenance... (You punished their predecessors and bestowed gifts upon those who came after them.)"

Benefits:
It is narrated in Jami‘ at-Tirmidhi that regarding Makkah Mukarramah, the Messenger of Allah (sallallahu alayhi wa sallam) said: ((By Allah, you are the best of Allah’s land and the most beloved land of Allah to me. By Allah, had I not been driven out from you, I would never have left.)) (Sunan at-Tirmidhi, Chapters on Virtues, no. 3925)
This shows that circumambulation (tawaf) can be performed at any time. ((Do not prevent anyone from circumambulating this House and praying at any hour he wishes, whether by night or by day.)) (Sunan Abi Dawud, Book of Hajj, Chapter: Tawaf after ‘Asr, no. 1894)
It is thus understood that the prohibited times for prayer are an exception in the case of the House of Allah (Bayt Allah). That is, it is permissible to perform prayer in the House of Allah at any time. Imam Ahmad and Imam Shafi‘i rahimahullah hold this view, whereas the majority (jumhur) and Imam Abu Hanifah rahimahullah are of the opinion that even in Masjid al-Haram, the prohibited times should be observed.
