It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) granted Sayyiduna Abbas bin Abdul Muttalib (may Allah be pleased with him) permission to spend the nights of Mina in Mecca because he used to provide water to the pilgrims.

Explanation & Benefits

Benefits: The days of Mina (11th, 12th, 13th of Dhul-Hijjah), during which the pilgrims stay in Mina, the nights of these days should be spent in Mina. However, if there is a valid excuse or necessity, there is concession in spending the nights outside Mina. Just as permission was granted to Sayyiduna Abbas radi Allahu anhu, similarly, it is narrated from Sayyiduna Asim bin Adi radi Allahu anhu that the Messenger of Allah sallallahu alayhi wa sallam granted permission to the camel herders to spend the nights outside Mina, that they should stone the Jamarat on the 10th of Dhul-Hijjah, then stone again on the second and third days, and then also on the day of departure. (Sunan Abi Dawud, no. 1975; Sunan Tirmidhi, no. 955; Sunan Ibn Majah, no. 3037)
However, without a valid excuse, it is not permissible to spend the night outside Mina. The position of the majority of scholars is that spending the nights in Mina during the days of Tashreeq is obligatory (wajib). Imam Nawawi rahimahullah has given preference to the view of the majority. (Sharh Muslim by Nawawi: 5/200)
