Hadith 342

اَخْبَرَنَا سُفْیَانُ، عَنِ الزُّهْرِیِّ، عَنْ عُبَیْدِاللّٰهِ بْنِ عَبْدِاللّٰهِ، عَنِ ابْنِ عَبَّاسٍ، اَنَّ الصَّعْبَ بْنَ جَثَّامَةَ اَهْدٰی لِرَسُوْلِ اللّٰهِ صَلَّی اللّٰهُ عَلَیْهِ وَسَلَّمَ لَحْمَ حِمَارٍ وَحْشِیٍّ، وَهُوَ مُحْرَمٌ فَرَدَّهٗ، فَلَمَّا رَاٰی الْکِرَاهِیَةَ فِیْ وَجْهِهٖ قَالَ: ((لَیْسَ بِنَا رَدٌّ عَلَیْكَ، وَلٰکِنَّا حُرْمٌ۔)).
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that Sa'b bin Jaththamah (may Allah be pleased with him) presented the meat of a wild donkey as a gift to the Messenger of Allah (peace and blessings be upon him) while he was in the state of Ihram, so the Prophet (peace and blessings be upon him) returned it. When he saw signs of sadness and displeasure on his face, he said: "We do not return your gift except that we are in the state of Ihram."

Explanation & Benefits

Benefits:
➊ It is not permissible to hunt while in the state of ihram, nor for a person in ihram (muhrim) to signal someone else to hunt. Allah the Exalted says: ﴿يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ﴾ (, al-Ma'idah: 95) ... “O you who believe! Do not kill game while you are in the state of ihram.”
In another verse: ﴿حُرِّمَ عَلَيْكُمْ صَيْدُ الْبَرِّ مَا دُمْتُمْ حُرُمًا﴾ (, al-Ma'idah: 96) ... “Land game is made unlawful for you as long as you are in the state of ihram.”
➋ From the aforementioned hadith, it is understood that even if a non-muhrim hunts for a muhrim, it is not permissible for the muhrim to eat it. In Sahih al-Bukhari, it is narrated from Sayyiduna Abu Qatadah al-Ansari radi Allahu anhu regarding the incident of hunting a wild donkey, when he himself was not in ihram, that the Messenger of Allah sallallahu alayhi wa sallam asked his companions, who were in ihram: “Did any of you command him (to hunt) or signal to him with anything?” The companions radi Allahu anhum replied: “No.” He sallallahu alayhi wa sallam said: “Then eat its meat.” (Bukhari, Kitab al-Hajj, no. 1824)
➌ In the first narration, it is stated that a muhrim cannot eat the meat of hunted game. In the second, it is stated that he can. The scholars have reconciled these hadiths by saying that a muhrim may only eat the meat of hunted game if the hunter is not in ihram, and he did not hunt specifically for the muhrim, nor did the muhrim assist in any way with the hunt.
➍ From the aforementioned hadith, it is also understood that if someone gives a gift, it should be accepted. If, due to some excuse, it is not accepted, then the excuse should be explained.
