Hadith 1765
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا الثِّقَةُ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ، عَنْ قَيْسٍ، عَنْ جَرِيرٍ، قَالَ: كَانَتْ بَجِيلَةُ رُبُعَ النَّاسِ، فَقَسَّمَ لَهَا رُبُعَ السَّوَادِ. فَاسْتَغَلُّوا ثَلَاثَ أَوْ أَرْبَعَ سِنِينَ، أَنَا شَكَكْتُ ثُمَّ قَدِمْتُ عَلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، وَمَعِي فُلَانَةُ بِنْتُ فُلَانٍ امْرَأَةٌ مِنْهُمْ قَدْ أَسْمَاهَا، لَا يَحْضُرُنِي ذِكْرُ اسْمِهَا. فَقَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: لَوْلَا أَنِّي قَاسِمٌ مَسْئُولٌ لَتَرَكَتْكُمْ عَلَى مَا قُسِمَ لَكُمْ، وَلَكِنِّي أَرَى أَنْ تَرُدُّوا عَلَى النَّاسِ. أَخْرَجَهُ مِنْ كِتَابِ السِّيَرِ عَلَى سِيَرِ الْوَاقِدِيِّ، وَهُوَ أَوَّلُ حَدِيثٍ فِيهِ.
Jarir (may Allah be pleased with him) narrated that the people of the Bajila tribe were a quarter of the people, so a quarter of the spoils (goods) was distributed to them. For three or four years (the narrator says) I am uncertain about this. They remained like this (i.e., their number remained large). Then I came to Umar ibn al-Khattab (may Allah be pleased with him), and with me was a woman from them, so-and-so bint so-and-so. The narrator says he mentioned her name but I do not remember it now. So Umar ibn al-Khattab (may Allah be pleased with him) said: If I were not a distributor who would be questioned, I would have left you with the wealth that was distributed to you. But now I think you should return (the wealth) to the people.
