Hadith 1747
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَمْرِو بْنِ سَعِيدٍ، عَنْ عُمَرَ بْنِ كَثِيرِ بْنِ أَفْلَحَ، عَنْ أَبِي مُحَمَّدٍ مَوْلَى أَبِي قَتَادَةَ، عَنْ أَبِي قَتَادَةَ الْأَنْصَارِيِّ، قَالَ: خَرَجْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ حُنَيْنٍ، فَلَمَّا الْتَقَيْنَا كَانَتِ لِلْمُسْلِمِينَ جَوْلَةٌ فَرَأَيْتُ رَجُلًا مِنَ الْمُشْرِكِينَ قَدْ عَلَا رَجُلًا مِنَ الْمُسْلِمِينَ، قَالَ: فَاسْتَدَرْتُ لَهُ حَتَّى أَتَيْتُهُ مِنْ وَرَائِهِ فَضَرَبْتُهُ عَلَى حَبْلِ عَاتِقِهِ ضَرْبَةً فَأَقْبَلَ عَلَيَّ فَضَمَّنِي ضَمَّةً وَجَدْتُ مِنْهَا رِيحَ الْمَوْتِ، ثُمَّ أَدْرَكَهُ الْمَوْتُ فَأَرْسَلَنِي، فَلَحِقْتُ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقُلْتُ لَهُ: مَا بَالُ النَّاسِ؟ قَالَ: أَمْرُ اللَّهِ، ثُمَّ إِنَّ النَّاسَ رَجَعُوا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "مَنْ قَتَلَ قَتِيلًا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ" ، فَقُمْتُ، فَقُلْتُ: مَنْ يَشْهَدُ لِي؟ ثُمَّ جَلَسْتُ، فَقَالَهَا الثَّانِيَةَ، فَقُمْتُ فَقُلْتُ: مَنْ [ ص: 35 ] يَشْهَدُ لِي ثُمَّ جَلَسْتُ، فَقَالَهَا الثَّالِثَةَ، فَقُمْتُ فِي الثَّالِثَةِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: مَا لَكَ يَا أَبَا قَتَادَةَ؟ فَاقْتَصَصْتُ عَلَيْهِ الْقِصَّةَ، فَقَالَ رَجُلٌ مِنَ الْقَوْمِ: صَدَقَ يَا رَسُولَ اللَّهِ، وَسَلَبُ ذَلِكَ الْقَتِيلِ عِنْدِي، فَأَرْضِهِ عَنِّي، فَقَالَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: لَاهَا اللَّهِ إِذًا لَا نَعْمِدُ إِلَى أَسَدٍ مِنْ أُسْدِ اللَّهِ تَعَالَى يُقَاتِلُ عَنِ اللَّهِ تَعَالَى فَنُعْطِيكَ سَلَبَهُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "صَدَقَ فَأَعْطَاهُ إِيَّاهُ" قَالَ أَبُو قَتَادَةَ: فَأَعْطَانِيهِ، فَبَعَثَ الدِّرْعَ، فَابْتَعْتُ مَخْرَفًا فِي بَنِي سَلَمَةَ، فَإِنَّهُ لَأَوَّلُ مَا تَأَثَّلْتُ فِي الْإِسْلَامِ. قَالَ مَالِكٌ: الْمَخْرَفُ النَّخْلُ. أَخْرَجَهُ فِي كِتَابِ اخْتِلَافِ مَالِكٍ وَالشَّافِعِيِّ.
Abu Qatadah Ansari (may Allah be pleased with him) narrated: We set out with the Messenger of Allah ﷺ in the year of the Battle of Hunayn. When we met the enemy, at first the Muslims began to waver. I saw a man from among the polytheists who had overpowered a Muslim. I quickly turned towards him until I came from behind and struck his neck with my sword. Then he turned towards me and squeezed me so hard that I feared for my life. Then death overtook him and he let me go. Later, I met Umar ibn Khattab (may Allah be pleased with him) and asked him: What is the state of the people now? He said: What Allah had decreed has happened. Then the people (i.e., the Muslims) returned to the battle (i.e., they regrouped). The Messenger of Allah ﷺ said: “Whoever kills a disbeliever and has proof of it, then all his belongings will be given to him.” (Abu Qatadah, may Allah be pleased with him, says) I stood up and said: Who will testify for me? Then I sat down. The Prophet ﷺ repeated the same statement, so I stood up and said: Who will testify for me? (No one testified) so I sat down again. The Prophet ﷺ repeated the same statement a third time, so I stood up a third time. The Messenger of Allah ﷺ said: “O Abu Qatadah, what is it?” Then I narrated the whole incident before him. A man from the people said: O Messenger of Allah ﷺ! He has spoken the truth, and the belongings of the slain man are with me, so please make him pleased with me regarding this. But Abu Bakr (may Allah be pleased with him) said: No, by Allah! We will not do this to one of Allah’s lions who fought for Allah’s sake and then give his belongings to you. The Messenger of Allah ﷺ said: Abu Bakr has spoken the truth. Then he ﷺ gave the belongings to him (Abu Qatadah). Abu Qatadah (may Allah be pleased with him) said: The Prophet ﷺ gave me those belongings, so I sold the armor and bought a garden in Banu Salamah, and this was the first wealth I acquired after accepting Islam. Imam Malik said: “Mukhraf” means a date-palm (tree).
