Hadith 1709
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ الْحَارِثِ بْنِ عَبْدِ الْمَلِكِ الْمَخْزُومِيُّ، عَنْ سَيْفِ بْنِ سُلَيْمَانَ الْمَكِّيِّ، عَنْ قَيْسِ بْنِ سَعْدٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ. قَالَ عَمْرٌو: فِي الْأَمْوَالِ.
It is narrated from Ibn Abbas (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) gave a verdict based on an oath and one witness.
Hadith 1710
أَخْبَرَنَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ، عَنْ رَبِيعَةَ بْنِ عُثْمَانَ، عَنْ مُعَاذِ بْنِ عَبْدِ الرَّحْمَنِ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ، وَرَجُلٍ آخَرَ سَمَّاهُ، فَلَا يَحْضُرُنِي ذِكْرُ اسْمِهِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ.
It is narrated from Mu'adh bin Abdur Rahman that he narrated from Ibn Abbas (may Allah be pleased with him) and another man whose name he mentioned (but I do not remember his name now), who was among the companions of the Prophet ﷺ, that the Messenger of Allah ﷺ gave a verdict based on an oath and one witness.
Hadith 1711
أَخْبَرَنَا إِبْرَاهِيمُ، عَنْ عَمْرِو بْنِ أَبِي عَمْرٍو مَوْلَى الْمُطَّلِبِ، عَنِ ابْنِ الْمُسَيِّبِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ.
It is narrated from Ibn Musayyib (may Allah have mercy on him) that the Messenger of Allah (ﷺ) gave a verdict in a case based on an oath and one witness.
Hadith 1712
أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدِ بْنِ أَبِي عُبَيْدٍ الدَّرَاوَرْدِيُّ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ سَعِيدِ بْنِ عَمْرِو بْنِ شُرَحْبِيلَ بْنِ سَعِيدِ بْنِ سَعْدِ بْنِ عُبَادَةَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ: وَجَدْنَا فِي كُتُبِ سَعْدٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ.
It is narrated from Saeed bin Amr bin Shurahbeel bin Saeed bin Saad bin Ubadah, from his father, and he from his grandfather, that he said: "We found written in the books of Saad (may Allah be pleased with him) that the Messenger of Allah (ﷺ) gave a judgment with an oath and one witness."
Hadith 1713
أَخْبَرَنَا الشَّافِعِيُّ قَالَ: وَذَكَرَ عَبْدُ الْعَزِيزِ بْنُ عَبْدِ الْمُطَّلِبِ، عَنْ سَعِيدِ بْنِ عَمْرٍو، عَنْ أَبِيهِ قَالَ: وَجَدْنَا فِي كُتُبِ سَعْدِ بْنِ عُبَادَةَ يَشْهَدُ سَعْدُ بْنُ عُبَادَةَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَ عَمْرَو بْنَ حَزْمٍ أَنْ يَقْضِيَ بِالْيَمِينِ مَعَ الشَّاهِدِ.
Amr bin Shurahbil narrated that we found in the books of Sa'd bin Ubadah (may Allah be pleased with him), Sa'd bin Ubadah (may Allah be pleased with him) testifies that the Messenger of Allah (ﷺ) ordered Amr bin Hazm (may Allah be pleased with him) to judge with an oath and one witness.
Hadith 1714
أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ. قَالَ عَبْدُ الْعَزِيزِ: فَذَكَرْتُ ذَلِكَ لِسُهَيْلٍ، قَالَ: أَخْبَرَنِي رَبِيعَةُ، وَهُوَ عِنْدِي ثِقَةٌ أَنِّي حَدَّثْتُهُ إِيَّاهُ، وَلَا أَحْفَظُهُ. قَالَ عَبْدُ الْعَزِيزِ: وَقَدْ كَانَ أَصَابَ سُهَيْلًا عِلَّةٌ أُصِيبَ بِبَعْضِ حِفْظِهِ وَنَسِيَ بَعْضَ حَدِيثِهِ فَكَانَ سُهَيْلٌ بَعْدُ يُحَدِّثُهُ عَنْ رَبِيعَةَ، عَنْهُ، عَنْ أَبِيهِ.
It is narrated from Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) gave a verdict based on an oath and one witness.
Hadith 1715
أَخْبَرَنَا مَالِكٌ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ.
Ja'far bin Muhammad (may Allah have mercy on him) narrated from his father that the Prophet ﷺ gave a verdict based on an oath and one witness.
Hadith 1716
أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، قَالَ: حَدَّثَنِي جَعْفَرُ بْنُ مُحَمَّدٍ، قَالَ: سَمِعْتُ الْحَكَمَ بْنَ عُتَيْبَةَ يَسْأَلُ أَبِي، وَقَدْ وَضَعَ يَدَهُ عَلَى جِدَارِ الْقَبْرِ لِيَقُومَ: أَقْضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالْيَمِينِ مَعَ الشَّاهِدِ؟ قَالَ: نَعَمْ وَقَضَى بِهَا عَلِيٌّ بَيْنَ أَظْهُرِكُمْ. قَالَ مُسْلِمٌ: قَالَ جَعْفَرٌ: فِي الدَّيْنِ.
Ja'far bin Muhammad (may Allah have mercy on him) narrated that I heard Hakam bin 'Utaybah asking my father while he was standing with his hand on the wall of a grave: (He asked) "Did the Prophet ﷺ give a judgment with an oath and one witness?" He replied: "Yes, and likewise 'Ali (may Allah be pleased with him) gave a judgment among you."
Hadith 1717
أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ فِي الشَّهَادَةِ: "فَإِنْ جَاءَ بِشَاهِدٍ حَلَفَ مَعَ شَاهِدٍ" .
Amr bin Shu'aib narrated from his father that the Prophet ﷺ said regarding testimony: "If (the claimant) brings one witness, then he should also swear an oath along with the witness (then the decision will be in his favor)."
Hadith 1718
أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ خَالِدِ بْنِ أَبِي كَرِيمَةَ، عَنْ أَبِي جَعْفَرٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ.
It is narrated from Abu Ja'far (may Allah have mercy on him) that the Messenger of Allah (ﷺ) gave a verdict based on an oath and one witness.
Hadith 1719
أَخْبَرَنَا الشَّافِعِيُّ: أَنَّهُ قَالَ لِبَعْضِ مَنْ يُنَاظِرُهُ قَالَ: فَقُلْتُ لَهُ: رَوَى الثَّقَفِيُّ، وَهُوَ ثِقَةٌ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ جَابِرٍ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ. [ ص: 22 ] أَخْرَجَ الْعَشَرَةَ الْأَحَادِيثَ مِنْ كِتَابِ الْيَمِينِ مَعَ الشَّاهِدِ، وَهِيَ أَوَّلُ مَا فِيهِ وَالْحَادِي عَشَرَ مِنْ كِتَابِ الْأُسَارَى وَالْغُلُولِ وَهُوَ آخِرُ مَا فِيهِ.
It is narrated from Jabir (may Allah be pleased with him) that the Prophet (peace be upon him) gave a verdict based on an oath and one witness.
