Hadith 1689
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ زَيْنَبَ بِنْتِ أَبِي سَلَمَةَ، عَنْ أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "إِنَّمَا أَنَا بَشَرٌ، وَإِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ، وَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ فَأَقْضِي لَهُ عَلَى نَحْوِ مَا أَسْمَعُ مِنْهُ، فَمَنْ قَضَيْتُ لَهُ بِشَيْءٍ مِنْ حَقِّ أَخِيهِ فَلَا يَأْخُذَنَّهُ فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ" .
Umm al-Mu’minin Sayyidah Umm Salamah (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) said: “Indeed, I am a human being, and you bring your disputes to me. It is possible that one of you may be more eloquent in presenting his case than the other, and I judge in his favor based on what I hear. So, if I give someone a right that belongs to his brother, then he should not take it, for in that way I am allotting for him a piece of the Hellfire.”
Hadith 1690
أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامٍ، عَنْ أَبِيهِ، عَنْ زَيْنَبَ بِنْتِ أَبِي سَلَمَةَ، عَنْ أُمِّ سَلَمَةَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "إِنَّمَا أَنَا بَشَرٌ مِثْلُكُمْ، وَإِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ فَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ، فَأَقْضِي لَهُ عَلَى نَحْوِ مَا أَسْمَعُ مِنْهُ، فَمَنْ قَضَيْتُ لَهُ [ ص: 10 ] بِشَيْءٍ مِنْ حَقِّ أَخِيهِ فَلَا يَأْخُذْ مِنْهُ فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ" . أَخْرَجَ الْأَوَّلَ مِنْ كِتَابِ الْيَمِينِ مَعَ الشَّاهِدِ وَالثَّانِيَ مِنْ كِتَابِ إِبْطَالِ الِاسْتِحْسَانِ، وَهُوَ آخِرُ حَدِيثٍ فِيهِ.
It is narrated from Umm Salamah (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: "Indeed, I am only a human being like you, and you bring your disputes to me. It may be that some of you are more eloquent in presenting their case than others, so I judge in their favor based on what I hear. So, if I judge in someone's favor at the expense of his brother's right, then he should not take it, for in that case I am allotting for him a piece of the Hellfire."
