It is narrated from Abu Huraira (may Allah be pleased with him) that the Prophet (ﷺ) gave the ruling, regarding the child of a woman from Banu Lihyan who was born dead due to being struck by another woman, that as blood money a slave man or slave woman should be given. Then he said that the woman who caused the miscarriage, about whom the Prophet (ﷺ) had given the verdict, passed away, so the Messenger of Allah (ﷺ) ruled that her inheritance is for her sons and husband, and the payment of the blood money is upon her 'asaba (male relatives on the father's side).

Imam Shafi’i, may Allah have mercy on him, said: If someone asks, “How is it regarding the matter in which the Prophet ﷺ gave the ruling of paying blood money for the fetus to the woman?” then it will be said: A trustworthy person has informed us. Al-Rabi’ said: He is Yahya bin Hassan. He narrated from Al-Layth bin Sa’d, who narrated from Ibn Shihab, who narrated from Ibn al-Musayyib, who narrated from Abu Hurairah, may Allah be pleased with him.

It is narrated from Ibn Musayyib (may Allah have mercy on him) that the Prophet ﷺ gave the verdict of giving a slave or a slave-girl as compensation for the child who is killed in the womb of his mother. The one against whom the verdict was given said: "How can I pay compensation for something that has neither drunk nor eaten, neither spoken nor made any sound at the time of birth? In such a case, would the compensation not be wasted?" Upon this, the Messenger of Allah ﷺ said: "This person seems to be a brother of the soothsayers."

It is narrated from Tawoos (may Allah have mercy on him) that Umar bin Khattab (may Allah be pleased with him) asked: "I put under oath by Allah the one who has heard anything from the Prophet ﷺ regarding the fetus (unborn child in the womb)?" So Haml bin Malik bin Nabighah (may Allah be pleased with him) stood up and said: "I used to live between my two wives. One of them struck the other with a tent pole, and she miscarried a dead fetus. In this matter, the Messenger of Allah ﷺ ruled for a slave or a slave-girl." Then Umar (may Allah be pleased with him) said: "It was close that we would have given a verdict in this matter based on our own opinion."

It is narrated from Tawus that Umar bin Khattab (may Allah be pleased with him) said: "Is there anyone who has heard anything from the Prophet ﷺ regarding the fetus?" Then Haml bin Malik bin Nabighah (may Allah be pleased with him) stood up and said: "I was living with my two co-wives when one of them struck the other with a tent pole, causing her to miscarry a dead child. In this matter, the Messenger of Allah ﷺ ruled for a slave or a slave-girl." Then Umar (may Allah be pleased with him) said: "If we had not heard this, we would have given a different verdict in this case."
