Ali bin Husain (may Allah have mercy on him) narrated: By Allah, the Messenger of Allah (ﷺ) did not gouge out eyes, and did nothing except cut off the hands and feet of those who herded the milking camels.

It is narrated from Salih, the freed slave of Tuamah, that regarding bandits, Ibn Abbas (may Allah be pleased with him) said: When they commit murder and also loot wealth, they will be killed and crucified; and when they commit murder but do not loot wealth, they will be killed but not crucified; and when they loot wealth but do not commit murder, their hands and feet will be cut off from opposite sides; and when they only frighten travelers without looting wealth, they will be exiled.

Amr bin Dinar stated that everything is in the Qur'an or for it as He willed. Ibn Jurayj said, except for the statement of Allah Almighty: "Indeed, the penalty for those who wage war against Allah and His Messenger..." (__QUR_5_33__), that there is no choice given in it. Imam Shafi'i, may Allah have mercy on him, also said as Ibn Jurayj and others have said: "Indeed, the penalty for those who wage war against Allah and His Messenger..." (__QUR_5_33__). I say that this issue is regarding the one who wages war.
