Hadith 1595
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ أَبِي حُسَيْنٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: "لَا قَطْعَ فِي ثَمَرٍ مُعَلَّقٍ فَإِذَا آوَاهُ الْجَرِينُ فَفِيهِ الْقَطْعُ" .
Amr bin Shu'aib (may Allah be pleased with him) narrated from the Prophet (ﷺ) that he (ﷺ) said: "The hand is not to be cut for (stealing) hanging fruit. However, when it is gathered in the threshing floor (an open place), then the hand is to be cut for it."
Hadith 1596
أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حِبَّانَ، عَنْ عَمِّهِ وَاسِعِ بْنِ حِبَّانَ، أَنَّ رَافِعَ بْنَ خَدِيجٍ أَخْبَرَهُ: أَنَّهُ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: "لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ" .
Rafi' bin Khadij (may Allah be pleased with him) narrated that he heard the Messenger of Allah (ﷺ) say: "The hand is not to be cut off for fruit or the pit of a date."
Hadith 1597
أَخْبَرَنَا سُفْيَانُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حِبَّانَ، عَنْ عَمِّهِ وَاسِعِ بْنِ حِبَّانَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمِثْلِهِ. أَخْرَجَ الثَّلَاثَةَ الْأَحَادِيثَ مِنْ كِتَابِ الْقَطْعِ فِي السَّرِقَةِ.
Through another chain as well, it is narrated from Rafi' bin Khadij, may Allah be pleased with him, from the Prophet, peace and blessings be upon him, similar to the previous hadith.
