Hadith 1583
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ ابْنِ شِهَابٍ، عَنْ عَمْرَةَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا" .
Narrated from Aisha (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: "A hand is cut off for a quarter dinar or more."
Hadith 1584
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَطَعَ سَارِقًا فِي مِجَنٍّ قِيمَتُهُ ثَلَاثَةُ دَرَاهِمَ.
It is narrated from Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace be upon him) cut off the hand of a thief for stealing a shield whose value was three dirhams.
Hadith 1585
أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرِ بْنِ حَزْمٍ، عَنْ أَبِيهِ، عَنْ عَمْرَةَ [ ص: 278 ] بِنْتِ عَبْدِ الرَّحْمَنِ: أَنَّ سَارِقًا سَرَقَ أُتْرُجَّةً فِي عَهْدِ عُثْمَانَ، فَأَمَرَ بِهَا عُثْمَانُ فَقُوِّمَتْ ثَلَاثَةَ دَرَاهِمَ مَنْ صَرْفِ اثْنَيْ عَشَرَ بِدِينَارٍ، فَقَطَعَ يَدَهُ.
It is narrated from Umrah bint Abd al-Rahman that during the time of Uthman (may Allah be pleased with him), a thief stole an orange. Uthman (may Allah be pleased with him) ordered that its value be assessed, and it was determined to be three dirhams, at the rate of twelve dirhams per dinar, so he had the thief's hand cut off. Imam Malik (may Allah have mercy on him) said: And this is the orange that people eat.
Hadith 1586
قَالَ مَالِكٌ: وَهِيَ الْأُتْرُجَّةٌ الَّتِي يَأْكُلُهَا النَّاسُ. أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ حُمَيْدٍ الطَّوِيلِ: أَنَّهُ سَمِعَ قَتَادَةَ يَسْأَلُ أَنَسَ بْنَ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ عَنِ الْقَطْعِ، فَقَالَ أَنَسٌ: حَضَرْتُ أَبَا بَكْرٍ الصِّدِّيقَ رَضِيَ اللَّهُ عَنْهُ قَطَعَ سَارِقًا فِي شَيْءٍ مَا يَسُرُّنِي أَنَّهُ لِي بِثَلَاثَةِ دَرَاهِمَ.
It is narrated from Humaid At-Tawil that he heard Qatadah (may Allah have mercy on him) asking Anas bin Malik (may Allah be pleased with him) about cutting off the hand. So Anas (may Allah be pleased with him) said: "I went to Abu Bakr As-Siddiq (may Allah be pleased with him), and he cut off the hand of a thief for something which I would not like to take even for three dirhams."
Hadith 1587
أَخْبَرَنَا غَيْرُ وَاحِدٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: الْقَطْعُ فِي رُبُعِ دِينَارٍ فَصَاعِدًا.
It is narrated from Ali (may Allah be pleased with him) that the hand is cut off for a quarter dinar or more.
Hadith 1588
أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ: أَنَّهَا قَالَتْ: خَرَجَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا إِلَى مَكَّةَ شَرَّفَهَا اللَّهُ تَعَالَى وَمَعَهَا مَوْلَاتَانِ وَغُلَامٌ لِابْنِ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، فَبَعَثَتْ مَعَ مَوْلَاتَيْنِ بِبُرْدٍ مُرَجَّلٍ قَدْ خِيطَتْ عَلَيْهِ خِرْقَةٌ خَضْرَاءُ. قَالَتْ: فَأَخَذَ الْغُلَامُ الْبُرْدَ فَفَتَقَ عَنْهُ فَاسْتَخْرَجَهُ وَجَعَلَ مَكَانَهُ لِبْدًا أَوْ فَرْوَةً، وَخَاطَ عَلَيْهِ، فَلَمَّا قَدِمَتِ الْمَوْلَاتَانِ الْمَدِينَةَ دَفَعَتَا ذَلِكَ إِلَى أَهْلِهِ، فَلَمَّا فَتَقُوا عَنْهُ وَجَدُوا فِيهِ اللِّبْدَ وَلَمْ يَجِدُوا فِيهِ الْبُرْدَ، فَكَلَّمُوا الْمَوْلَاتَيْنِ فَكَلَّمَتَا عَائِشَةَ زَوْجَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَطَعَتْ يَدَهُ، وَقَالَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا: الْقَطْعُ فِي رُبُعِ دِينَارٍ فَصَاعِدًا.
It is narrated from ‘Amrah bint ‘Abd al-Rahman that when ‘A’ishah (may Allah be pleased with her) set out towards Makkah, two freed slave women and the slave of the son of ‘Abdullah ibn Abi Bakr (may Allah be pleased with them) were with her. ‘A’ishah (may Allah be pleased with her) sent a sheet with designs on it to those two slave women, wrapped and sewn in a green cloth. ‘Amrah said: (On the way) the slave undid the stitching, took out the sheet, and put a bag or a sheepskin in its place, then sewed it up again. When the two slave women reached Madinah, they handed over the trust to the family. When they undid the stitching and looked, they found a sheepskin instead of the sheet. They asked the slave women, and they mentioned the matter (of suspicion about the slave) to Umm al-Mu’minin, Lady ‘A’ishah (may Allah be pleased with her). Then ‘A’ishah (may Allah be pleased with her) had his hand cut off and said: “A hand is cut off for a quarter dinar or more.”
Hadith 1589
أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ: أَنَّ رَجُلًا مِنْ أَهْلِ الْيَمَنِ أَقْطَعَ الْيَدِ وَالرِّجْلِ، قَدِمَ عَلَى أَبِي بَكْرٍ الصِّدِّيقِ رَضِيَ اللَّهُ عَنْهُ، فَشَكَا إِلَيْهِ أَنَّ عَامِلَ الْيَمَنِ ظَلَمَهُ، وَكَانَ يُصَلِّي مِنَ اللَّيْلِ، فَيَقُولُ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: وَأَبِيكَ مَا لَيْلُكَ بِلَيْلِ سَارِقٍ. ثُمَّ إِنَّهُمُ افْتَقَدُوا حُلِيًّا لِأَسْمَاءَ بِنْتِ عُمَيْسٍ، امْرَأَةِ أَبِي بَكْرٍ رَضِيَ اللَّهُ عَنْهُ، فَجَعَلَ الرَّجُلُ يَطُوفُ مَعَهُمْ، وَيَقُولُ: اللَّهُمَّ عَلَيْكَ بِمَنْ بَيَّتَ أَهْلَ هَذَا الْبَيْتِ الصَّالِحِ، فَوَجَدُوا الْحُلِيَّ عِنْدَ صَائِغٍ، وَأَنَّ الْأَقْطَعَ جَاءَ بِهِ فَاعْتَرَفَ الْأَقْطَعُ أَوْ شَهِدَ عَلَيْهِ، فَأَمَرَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ، فَقُطِعَتْ يَدُهُ الْيُسْرَى. وَقَالَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: وَاللَّهِ لَدُعَاؤُهُ عَلَى نَفْسِهِ أَشَدُّ عِنْدِي مِنْ سَرِقَتِهِ. أَخْرَجَ السِّتَّةَ الْأَحَادِيثَ مِنْ كِتَابِ الْقَطْعِ فِي السَّرِقَةِ.
Abdur Rahman bin Qasim narrates from his father that a man from Yemen, whose one hand and one foot were cut off, came to Abu Bakr Siddiq (may Allah be pleased with him) and complained that the ruler of Yemen had wronged him. He used to pray at night, so Abu Bakr (may Allah be pleased with him) said: "By your father's oath! Your night is not the night of thieves." Then the jewelry of Abu Bakr's (may Allah be pleased with him) wife, Asma bint Umais (may Allah be pleased with her), was stolen, so this man also searched with the people and said: "O Allah! Destroy the one who has stolen from such righteous householders." Then they found the necklace with a goldsmith, (who said that) this same man with the cut limbs had brought it. The Yemeni thief confessed or it was proven by testimony, so Abu Bakr (may Allah be pleased with him) cut off his (remaining) left hand as well, and said: "By Allah! The cunning curse he used to invoke upon himself seemed harsher to me than his theft."
