Hadith 1580
قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا سُفْيَانُ، عَنْ أَيُّوبَ بْنِ أَبِي مُوسَى، عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ، وَلَا يُثَرِّبْ عَلَيْهَا، ثُمَّ إِنْ عَادَتْ فَزَنَتْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا، ثُمَّ إِنْ عَادَتْ فَزَنَتْ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِضَفِيرٍ مِنْ شَعَرٍ، يَعْنِي: الْحَبْلَ . It is narrated from Abu Hurairah (may Allah be pleased with him) that the Prophet (ﷺ) said: "When any of your slave girls commits adultery, and her adultery becomes evident, then impose the prescribed punishment of lashes on her, but do not reproach her. If she commits adultery again and it becomes evident, then again impose the prescribed punishment of lashes on her and do not curse her. If she commits adultery a third time and it becomes evident, then sell her, even if it is for the price of a rope of hair."
Hadith 1581
أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ عَلِيٍّ: أَنَّ فَاطِمَةَ بِنْتَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَدَّتْ جَارِيَةً لَهَا زَنَتْ. أَخْرَجَ الْأَوَّلَ مِنْ كِتَابِ اخْتِلَافِ عَلِيٍّ وَعَبْدِ اللَّهِ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ، وَالثَّانِيَ مِنْ كِتَابِ الْجَنَائِزِ.
It is narrated from Hasan bin Muhammad bin Ali that Fatimah (may Allah be pleased with her), the daughter of the Messenger of Allah (ﷺ), carried out the prescribed punishment on her slave woman who had committed adultery.
