It is narrated from ‘Ubadah bin Samit (may Allah be pleased with him) that the Prophet (ﷺ) said: “Learn from me, learn from me. Allah Almighty has prescribed a way for women. If an unmarried man commits fornication with an unmarried woman, each of them is to receive one hundred lashes and exile for one year. And if a married man and a married woman commit adultery, then one hundred lashes and stoning (to death).”

Imam Shafi’i, may Allah have mercy on him, said: A trustworthy narrator informed me that Hasan used to mention Hittan al-Ruqashi as an intermediary between himself and ‘Ubadah, may Allah be pleased with him. Now, I do not know whether ‘Abd al-Wahhab, may Allah have mercy on him, mentioned this intermediary between the two of them. I checked my original book, but it was not present in it. Or perhaps, since I wrote this book, its original has been missing from me.

Saeed bin Musayyib (may Allah have mercy on him) narrates that Umar bin Khattab (may Allah be pleased with him) said: "Beware lest you forget the verse of stoning, and (after a long time has passed) someone says, 'We do not find two prescribed punishments in the Qur'an.' The Messenger of Allah (ﷺ) carried out stoning, and we also stoned. By Him in Whose hand is my soul! If I were not afraid that people would say that Umar (may Allah be pleased with him) has added to the Book of Allah, I would have written it: 'When a married man and a married woman commit adultery, stone them both.' Indeed, we have recited this."

It is narrated from Abu Huraira and Zaid bin Khalid Al-Juhani (may Allah be pleased with them) that two men brought their dispute before the Messenger of Allah (ﷺ). One of them said: "O Messenger of Allah! Judge between us according to the Book of Allah." The other, who was more understanding of the two, said: "Yes, O Messenger of Allah (ﷺ)! Judge between us according to the Book of Allah, and allow me to speak regarding this matter." The Prophet (ﷺ) said: "Speak." The man said: "My son was working as a laborer with this man, and he committed adultery with his wife. I was told that my son would be stoned to death, so I gave him one hundred sheep and a slave girl as ransom for my son. Then I asked the people of knowledge, and they informed me that for my son the punishment is one hundred lashes and one year of exile, and the punishment of stoning is for his wife." Upon this, the Messenger of Allah (ﷺ) said: "By Him in Whose hand is my soul! I will judge between you according to the Book of Allah. Your sheep and your slave girl will be returned to you." Then he (ﷺ) had the son flogged with one hundred lashes and exiled for one year, and he ordered Anas Al-Aslami (may Allah be pleased with him) to go to the wife of the other man; if she confessed, she should be stoned. Umar (may Allah be pleased with him) sent Abu Waqid Al-Laithi (may Allah be pleased with him) to the man's wife to inquire about the matter. When he came to her, there were other women sitting with her. He told her what her husband had said about her to Umar bin Khattab (may Allah be pleased with him), and also told her that she would not be held accountable based solely on his statement.
