Hadith 1565
حَدَّثَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّهُ أَخْبَرَهُ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ خَرَجَ عَلَيْهِمْ، فَقَالَ: إِنِّي وَجَدْتُ مَعَ فُلَانٍ رِيحَ شَرَابٍ، فَزَعَمَ أَنَّهُ شَرِبَ الطِّلَاءَ وَأَنَا سَائِلٌ عَمَّا شَرِبَ، فَإِنْ كَانَ مُسْكِرًا جَلَدْتُهُ، [ ص: 266 ] فَجَلَدَهُ عُمَرُ الْحَدَّ تَامًّا.
Sa’ib bin Yazid (may Allah be pleased with him) narrated that Umar bin Khattab (may Allah be pleased with him) came out towards him and said: “I detected the smell of alcohol from such-and-such person, and he claims that he drank tila’ (thick syrup). I will investigate what he drank; if it is intoxicating, I will flog him.” Then Umar (may Allah be pleased with him) carried out the full prescribed punishment on him.
Hadith 1566
أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ خَرَجَ فَصَلَّى عَلَى جِنَازَةٍ، فَسَمِعَهُ السَّائِبُ يَقُولُ: إِنِّي وَجَدْتُ مَعَ عُبَيْدِ اللَّهِ وَأَصْحَابِهِ رِيحَ الشَّرَابِ، وَأَنَا سَائِلٌ عَمَّا شَرِبُوا، فَإِنْ كَانَ مُسْكِرًا حَدَدْتُهُمْ. قَالَ: قَالَ سُفْيَانُ: فَأَخْبَرَنِي مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّهُ حَضَرَهُ يَحُدُّهُمْ.
It is narrated from Sa’ib bin Yazid (may Allah be pleased with him) that when Umar bin Khattab (may Allah be pleased with him) came out to lead the funeral prayer, Sa’ib heard him say: "I have smelled alcohol from Ubaidullah and his companions. I will investigate what they have drunk; if it is intoxicating, I will enforce the prescribed punishment (hadd) upon them." Sa’ib bin Yazid says that he was present there at the time when the punishment was carried out on them.
Hadith 1567
أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ الزَّنْجِيُّ، عَنْ يَحْيَى بْنِ جُرَيْجٍ، قَالَ: قُلْتُ لِعَطَاءٍ: أَيُجْلَدُ فِي رِيحِ الشَّرَابِ؟ فَقَالَ عَطَاءٌ: إِنَّ الرِّيحَ لَتَكُونُ مِنَ الشَّرَابِ الَّذِي فِيهِ بَأْسٌ، فَإِذَا اجْتَمَعُوا جَمِيعًا عَلَى شَرَابٍ وَاحِدٍ فَسَكِرَ أَحَدُهُمْ جُلِدُوا جَمِيعًا الْحَدَّ تَامًّا. قَالَ الشَّافِعِيُّ: وَقَوْلُ عَطَاءٍ مِثْلُ قَوْلِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُمَا لَا يُخَالِفُهُ.
Yahya bin Jurayj said: I asked Ata (may Allah have mercy on him), "Will the legal punishment (hadd) be imposed if the smell of wine is detected?" Ata (may Allah have mercy on him) replied: "The smell comes from that wine in which there is harm (intoxication). So, if many people drink the same kind of wine and only one of them becomes intoxicated, then the full punishment of lashes will be imposed on all of them." Imam Shafi'i (may Allah have mercy on him) said: Ata's statement is exactly like the statement of Umar (may Allah be pleased with them both).
Hadith 1568
أَخْبَرَنَا إِبْرَاهِيمُ بْنُ أَبِي يَحْيَى، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ: أَنَّ عَلِيَّ بْنَ [ ص: 267 ] أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ قَالَ: لَا أُوتَى بِأَحَدٍ شَرِبَ خَمْرًا وَلَا نَبِيذًا مُسْكِرًا إِلَّا جَلَدْتُهُ الْحَدَّ. أَخْرَجَ الْأَرْبَعَةَ الْأَحَادِيثَ مِنْ كِتَابِ الْأَشْرِبَةِ.
Ja'far bin Muhammad narrates from his father that Ali bin Abi Talib, may Allah be pleased with him, said: "Whoever is brought to me for drinking wine or intoxicating nabidh, I will certainly impose the punishment of lashes upon him."
