Hadith 1562
حَدَّثَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَزْهَرَ، قَالَ: رَأَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ حُنَيْنٍ يَسْأَلُ عَنْ رَحْلِ خَالِدِ بْنِ الْوَلِيدِ، فَجَرَيْتُ بَيْنَ يَدَيْهِ أَسْأَلُ عَنْ رَحْلِ خَالِدٍ، حَتَّى أَتَاهُ جَرِيحًا. وَأُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِشَارِبٍ، فَقَالَ: "اضْرِبُوهُ" ، فَضَرَبُوهُ بِالْأَيْدِي وَالنِّعَالِ وَأَطْرَافِ الثِّيَابِ وَحَثَوْا عَلَيْهِ مِنَ التُّرَابِ، ثُمَّ قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "بَكِّتُوهُ" ، فَبَكَّتُوهُ، ثُمَّ أَرْسَلَهُ. قَالَ: فَلَمَّا كَانَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ، فَسَأَلَ مَنْ حَضَرَ ذَلِكَ الْمَضْرُوبَ، فَقَوَّمَهُ أَرْبَعِينَ، فَضَرَبَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ فِي الْخَمْرِ أَرْبَعِينَ حَيَاتَهُ، ثُمَّ عُمَرُ رَضِيَ اللَّهُ عَنْهُ أَرْبَعِينَ، حَتَّى تَتَابَعَ النَّاسُ فِي شُرْبِ الْخَمْرِ، فَاسْتَشَارَ فَضَرَبَهُ ثَمَانِينَ.
Abdur Rahman bin Azhar (may Allah be pleased with him) narrated that I saw the Prophet (ﷺ) in the year of Hunain asking about the departure of Khalid bin Walid (may Allah be pleased with him), so I also started walking ahead of the Prophet (ﷺ) asking about Khalid’s camel-litter, until the Prophet (ﷺ) reached him and he was in an injured state. Then a drunkard was brought to the Prophet (ﷺ), so he said: “Beat him.” The Companions (may Allah be pleased with them) beat him with their hands, sandals, and the edges of their garments, and threw dust on him. Then the Prophet (ﷺ) said: “Rebuke him (say harsh words to him).” So the Companions rebuked him, then the Prophet (ﷺ) let him go. Abdur Rahman bin Azhar said: Then when Abu Bakr’s (may Allah be pleased with him) caliphate came, he asked those who had participated in the beating during the time of the Prophet (ﷺ), and they informed him of forty lashes, so Abu Bakr (may Allah be pleased with him) prescribed forty lashes for drinking wine during his lifetime. Then Umar (may Allah be pleased with him) also kept it at forty, until when people began to drink wine excessively, he consulted and then prescribed eighty lashes.
Hadith 1563
أَخْبَرَنَا مَالِكٌ، عَنْ ثَوْرِ بْنِ زَيْدٍ الدِّيلِيِّ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ اسْتَشَارَ فِي الْخَمْرِ يَشْرَبُهَا الرَّجُلُ، فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ: نَرَى فِيهَا أَنْ يُجْلَدَ [ ص: 265 ] ثَمَانِينَ؛ فَإِنَّهُ إِذَا شَرِبَ سَكِرَ، وَإِذَا سَكِرَ هَذَى، وَإِذَا هَذَى افْتَرَى، أَوْ كَمَا قَالَ: فَجَلَدَهُ عُمَرُ رَضِيَ اللَّهُ عَنْهُ ثَمَانِينَ فِي الْخَمْرِ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْأَشْرِبَةِ.
It is narrated from Thawr bin Zayd Al-Daylami that Umar bin Khattab (may Allah be pleased with him) sought advice regarding the one who drinks alcohol. Ali bin Abi Talib (may Allah be pleased with him) said: "We think that the one who drinks alcohol should be given eighty (80) lashes, because when he drinks alcohol, he becomes intoxicated, and when he becomes intoxicated, he speaks nonsense (utters incoherent words), and when he speaks nonsense, he fabricates slander (false accusations)." Or as he said. Then Umar (may Allah be pleased with him) gave eighty (80) lashes to the one who drank alcohol.
