Hadith 1384
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ، لَا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ يَدًا بِيَدٍ وَلَا تُشِفُّوا [ ص: 170 ] بَعْضَهُ عَلَى بَعْضٍ، وَلَا تَبِيعُوا مِنْهَا غَائِبًا بِنَاجِزٍ" .
It is narrated from Abu Sa'id Al-Khudri (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: "Do not sell gold for gold except equal for equal, and do not increase one over the other; and do not sell silver for silver except equal for equal, hand to hand, and do not increase one over the other; and do not sell something absent for something present among them."
Hadith 1385
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ، وَلَا تَبِيعُوا غَائِبًا بِنَاجِزٍ" .
It is narrated from Abu Sa'id Al-Khudri (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: "Do not sell gold for gold except in equal measure, and do not sell what is absent for what is present."
Hadith 1386
أَخْبَرَنَا مَالِكٌ: أَنَّهُ بَلَغَهُ عَنْ جَدِّهِ مَالِكِ بْنِ عَامِرٍ، عَنْ عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "لَا تَبِيعُوا الدِّينَارَ بِالدِّينَارَيْنِ، وَلَا الدِّرْهَمَ بِالدِّرْهَمَيْنِ" .
It is narrated from Uthman (may Allah be pleased with him) that he stated: The Messenger of Allah (peace and blessings be upon him) said: "Do not sell one dinar for two dinars, nor one dirham for two dirhams."
Hadith 1387
أَخْبَرَنَا مَالِكٌ، عَنْ مُوسَى بْنِ أَبِي تَمِيمٍ، عَنْ سَعِيدِ بْنِ يَسَارٍ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، [ ص: 171 ] أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا" .
It is narrated from Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "It is not permissible to have an excess in exchange of dinar for dinar and dirham for dirham."
Hadith 1388
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ: لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ، وَلَا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ.
It is narrated from Nafi‘ that Ibn ‘Umar (may Allah be pleased with them) said: Do not sell gold for gold except equal for equal, and do not make one more than the other; (similarly) do not sell silver for silver except equal for equal, and do not make one more than the other.
Hadith 1389
أَخْبَرَنَا مَالِكٌ، عَنْ حُمَيْدِ بْنِ قَيْسٍ، عَنْ مُجَاهِدٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ قَالَ: الدِّينَارُ بِالدِّينَارِ، وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا هَذَا عَهْدُ نَبِيِّنَا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَيْنَا وَعَهْدُنَا إِلَيْكُمْ.
It is narrated from Mujahid that Ibn Umar (may Allah be pleased with him) said: Dinar is for dinar and dirham is for dirham; any increase in them is not permissible. This is the covenant of our Prophet (ﷺ) with us and our covenant with you.
Hadith 1390
أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، أَنَّ مُعَاوِيَةَ بْنِ أَبِي سُفْيَانَ بَاعَ سِقَايَةً مِنْ ذَهَبٍ أَوْ وَرِقٍ بِأَكْثَرَ مِنْ وَزْنِهَا، فَقَالَ لَهُ أَبُو الدَّرْدَاءِ رَضِيَ اللَّهُ عَنْهُ: سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَنْهَى عَنْ مِثْلِ هَذَا. فَقَالَ مُعَاوِيَةُ: مَا أَرَى بِهَذَا بَأْسًا. فَقَالَ أَبُو الدَّرْدَاءِ: مَنْ يَعْذِرُنِي مِنْ مُعَاوِيَةَ، أُخْبِرُهُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَيُخْبِرُنِي عَنْ رَأْيِهِ لَا أُسَاكِنُكَ بِأَرْضٍ. أَخْرَجَ الْأَوَّلَ مِنْ كِتَابِ الْبُيُوعِ، وَإِلَى آخِرِ الرَّابِعِ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلَافِ الْحَدِيثِ، وَالْخَامِسَ فِي كِتَابِ اخْتِلَافِ مَالِكٍ وَالشَّافِعِيِّ، وَالسَّادِسَ وَالسَّابِعَ مِنْ كِتَابِ الرِّسَالَةِ.
It is narrated from Ata bin Yasar (may Allah have mercy on him) that Muawiyah bin Abi Sufyan (may Allah be pleased with him) once sold a gold or silver vessel for more than its weight. So Abu Darda (may Allah be pleased with him) said to him, "I heard the Prophet (ﷺ) forbidding this." Muawiyah (may Allah be pleased with him) said, "In my opinion, there is nothing wrong with it." So Abu Darda (may Allah be pleased with him) said, "Who will excuse me regarding Muawiyah? I narrate to him the hadith of the Messenger of Allah (ﷺ), and he tells me his own opinion. I will not stay in the land in which (O Muawiyah!) you reside."
