Hadith 1377
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنِي مَنْ لَا أَتَّهِمُ، عَنِ ابْنِ أَبِي ذِئْبٍ، قَالَ: أَخْبَرَنِي مَخْلَدُ بْنُ خُفَافٍ، قَالَ: ابْتَعْتُ غُلَامًا فَاسْتَغْلَلْتُهُ، ثُمَّ ظَهَرْتُ مِنْهُ عَلَى عَيْبٍ، فَخَاصَمْتُ فِيهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، فَقَضَى لِي بِرَدِّهِ، وَقَضَى عَلَيَّ بِرَدِّ غَلَّتِهِ، فَأَتَيْتُ عُرْوَةَ فَأَخْبَرْتُهُ، فَقَالَ: أَرُوحُ إِلَيْهِ الْعَشِيَّةَ، فَأُخْبِرُهُ أَنَّ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَخْبَرَتْنِي أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي مِثْلِ هَذَا أَنَّ الْخَرَاجَ بِالضَّمَانِ، فَعَجِلْتُ إِلَى عُمَرَ رَضِيَ اللَّهُ عَنْهُ، فَأَخْبَرْتُهُ مَا أَخْبَرَنِي عُرْوَةُ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. فَقَالَ عُمَرُ: فَمَا أَيْسَرَ عَلَيَّ مِنْ قَضَاءِ قَضِيَّتِهِ، وَاللَّهُ يَعْلَمُ أَنِّي لَمْ أُرِدْ فِيهِ إِلَّا الْحَقَّ، فَبَلَغَنِي فِيهِ سُنَّةٌ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَرُدُّ قَضَاءَ عُمَرَ وَأُنْفِذُ سُنَّةَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَرَاحَ إِلَيْهِ عُرْوَةُ، فَقَضَى لِي أَنْ آخُذَ الْخَرَاجَ مِنَ الَّذِي قَضَى بِهِ عَلَيَّ لَهُ.
Mukhlad bin Khafaf narrated that I bought a slave, then benefited from him, then found a defect in him. So I filed a case about it with Umar bin Abdul Aziz (may Allah have mercy on him), and he ruled that I should return the slave and also give back the grain (profit) earned from him. Then I went to Urwah (may Allah have mercy on him), and when I told him the matter, he said: I will go to him (Umar) in the evening and inform him that Aisha (may Allah be pleased with her) told me that the Messenger of Allah (ﷺ) ruled in such a case that the income belongs to the one who is liable and responsible for bearing the loss. I quickly went to Umar bin Abdul Aziz (may Allah have mercy on him) and told him what Urwah had narrated from Aisha (may Allah be pleased with her) from the Prophet (ﷺ). So Umar (may Allah have mercy on him) said: How easy it is for me to change my decision. Allah knows that I intended nothing but the truth in this matter, but now the way of the Messenger of Allah (ﷺ) has reached me in this matter, so I revoke Umar’s decision and implement the Sunnah of the Messenger of Allah (ﷺ). Then in the evening Urwah (may Allah have mercy on him) also came to him, and he ruled for me that I should take back that income.
Hadith 1378
أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ أَبِي ذِئْبٍ، عَنْ مَخْلَدِ بْنِ خُفَافٍ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ.
It is narrated from Aisha (may Allah be pleased with her) that the Messenger of Allah (peace be upon him) ruled that revenue (income) is due to liability (guarantee).
Hadith 1379
أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنْ هِشَامٍ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "الْخَرَاجُ بِالضَّمَانِ" .
Narrated Aisha (may Allah be pleased with her): The Prophet (ﷺ) said: "The benefit is for the one who bears the liability of loss."
Hadith 1380
قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ: أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ اشْتَرَى مِنْ عَاصِمِ بْنِ عَدِيٍّ جَارِيَةً فَأُخْبِرَ أَنَّ لَهَا زَوْجًا فَرَدَّهَا. أَخْرَجَ الْأَوَّلَ مِنْ كِتَابِ الرِّسَالَةِ، وَالثَّانِيَ وَالثَّالِثَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلَافِ الْحَدِيثِ، وَالرَّابِعَ مِنْ كِتَابِ اخْتِلَافِ عَلِيٍّ وَعَبْدِ اللَّهِ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.
It is narrated from Abu Salamah that Abdur Rahman bin Awf (may Allah be pleased with him) bought a slave woman from Asim bin Adi (may Allah be pleased with him), and he was informed that she had a husband, so he returned her.
