Hadith 1349
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنِ ابْنِ الْمُسَيِّبِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ كَانَ يَقُولُ: الدِّيَةُ لِلْعَاقِلَةِ، وَلَا تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا شَيْئًا، حَتَّى أَخْبَرَهُ الضَّحَّاكُ بْنُ سُفْيَانَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَيْهِ أَنْ يُورِثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَتِهِ، فَرَجَعَ إِلَيْهِ عُمَرُ رَضِيَ اللَّهُ عَنْهُ.
It is narrated from Sa'id bin al-Musayyib (may Allah have mercy on him) that 'Umar bin al-Khattab (may Allah be pleased with him) used to say that blood money is obligatory upon the heirs, and a wife will not inherit anything from her husband's blood money. Until Dahhak bin Sufyan (may Allah be pleased with him) informed him that the Messenger of Allah (ﷺ) had written to him instructing that the wife of Ashyam al-Dhibabi (may Allah be pleased with him) should be made an heir to his blood money. Then 'Umar (may Allah be pleased with him) retracted his previous position.
Hadith 1350
أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَى الضَّحَّاكِ بْنِ سُفْيَانَ أَنْ يُورِثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَتِهِ. قَالَ ابْنُ شِهَابٍ: وَكَانَ أَشْيَمُ قُتِلَ خَطَأً. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ.
It is narrated from Ibn Shihab that the Prophet ﷺ wrote to Dahhak bin Sufyan (may Allah be pleased with him) that make the wife of Ashyam al-Dhababi an heir from his blood money.
