Hadith 1341
أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ، وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ.
It is narrated from Ibn Umar (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) separated the two who invoked mutual cursing (li'an) and gave the boy to the woman.
Hadith 1342
أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّ رَجُلًا لَاعَنَ امْرَأَتَهُ فِي زَمَانِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَانْتَفَى مِنْ وَلَدِهَا، فَفَرَّقَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَهُمَا، وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ. أَخْرَجَ الْأَوَّلَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلَافِ الْحَدِيثِ، وَالثَّانِيَ مِنْ كِتَابِ الظِّهَارِ وَاللِّعَانِ وَهُوَ آخِرُ حَدِيثٍ فِيهِ.
It is narrated from Ibn Umar (may Allah be pleased with him) that during the time of the Prophet (peace be upon him), a man invoked li'an against his wife and then also disowned her child. So the Messenger of Allah (peace be upon him) separated the two and gave the child to the woman.
